ICJ memiliki yurisdiksi untuk menyelesaikan kasus sengketa dan memberikan advisory opinion. Salah satu kasus sengketa yang hingga kini belum terselesaikan ialah konflik Israel-Palestina. Hal tersebut membuat Majelis Umum dan negara-negara meminta advisory opinion terkait konflik tersebut. Berdasarkan Pasal 65 Statuta ICJ hanya organisasi internasional yang dapat meminta advisory opinion. Terdapat dua identifikasi masalah, yaitu: 1) Bagaimana mekanisme penyampaian oral statement oleh suatu negara terhadap advisory opinion di ICJ? dan 2) Bagaimana efektivitas peran negara Indonesia dalam penyampaian oral statement di ICJ terhadap advisory opinion tentang konsekuensi hukum yang timbul dari kebijakan dan praktik Israel di wilayah Palestina yang diduduki, termasuk Yerusalem Timur? Tujuan penelitian ini ialah untuk mengetahui mekanisme oral statement pada proses advisory opinion dan menganalisis efektivitas peran Indonesia terhadap proses tersebut. Peneliti menggunakan teori kepentingan nasional dan efektivitas hukum serta menggunakan metode yuridis normatif untuk menjawab identifikasi masalah. Hasil penelitian menunjukan bahwa mekanisme oral statement advisory opinion diatur dalam Pasal 65-68 Statuta ICJ serta Pasal 104 dan 105 ayat (2) Rules of Court. Kepentingan nasional negara-negara menyampaikan oral statement didasari kepentingan nasional inti, sekunder, dan umum. Indonesia berperan dalam proses advisory opinion yang mencakup merumuskan, menyusun, dan menyampaikan oral statement. Efektivitas oral statement negara Indonesia dilihat dari faktor hukum, sarana pendukung, dan budaya sudah cukup efektif namun faktor penegak hukum dan masyarakat belum efektif. This research addresses two problems, 1) How is the mechanism for deliveringm an oral statements by a country during the advisory opinion process at the ICJ? and 2) What effectiveness is the role of Indonesia in delivering oral statements at the ICJ regarding the advisory opinion on the legal consequences of Israel's policies and practices in the occupied Palestinian territories, including East Jerusalem? The objective of this research is to understand the mechanism of oral statements during the advisory opinion process and to analyze Indonesia's role in that process. The researcher employs the theory of national interest and legal effectiveness, using a juridical normative method to address the identified issues. The research findings indicate that the mechanism for oral statements in advisory opinions is regulated in Articles 65-68 ICJ Statute and Articles 104 and 105(2) Rules of Court. The national interests of countries delivering oral statements are based on core, secondary, and general national interests. Indonesia plays a role in this process by formulating, compiling, and delivering oral statements. The effectiveness of Indonesia's oral statements can be assessed from legal factors, supporting advice, and cultural influences, which are relatively effective. The researcher recommends that all UN member states, the Security Council, and Israel apply the advisory opinion that has been established.} }
