The identification of the problem in this study is how the legality of a siri marriage conducted by a husband and wife, one of whom has a mental disability, from the perspective of Law Number 16 of 2019 amending Law Number 1 of 1974 concerning Marriage and the Compilation of Islamic Law and what are the legal consequences of the siri marriage. The theory used in this research is the theory of legal certainty and justice. The research methods used are normative juridical and empirical juridical, with descriptive analysis research specifications. The data sources are primary and secondary data, with data collection techniques through documentation, observation, interviews. And data analysis is collecting, displaying, verification, concluding. As well as the research location in Kurungkambing Village. The conclusion in this study is that the legality of a siri marriage with a mentally disabled wife is a marriage that does not have legal legality or is illegal according to positive law. According to Islamic law, the marriage is valid. However, according to the Compilation of Islamic Law, in order to ensure the orderliness of marriage for the Islamic community, every marriage must be recorded. The position of the couple is not recognized by the state, because they do not have proof of a marriage certificate so they do not have legal certainty, do not have the right to legal protection of marital life in the event of domestic violence and divorce, and do not have inheritance rights according to the law. Suggestions for the government to provide socialization or education to increase public knowledge about the legality of siri marriages and their consequences and provide sanctions for deterrent effects and to perpetrators who have performed siri marriages to immediately carry out marriage validation.
