description: Gojek is an application-based online transportation service. In conducting its business, Gojek partners with drivers, establishing a partnership agreement with terms and conditions that must be fulfilled by Gojek drivers. One of the rules drivers must adhere to is the prohibition on transferring their accounts to third parties. This provision is set out in the partnership e-contract and Gojek’s Code of Conduct. Despite this rule, some drivers still engage in account transfers to third parties through buying and selling transactions. Based on this, the problem identified in this research is how consumer protection and Gojek's corporate responsibility are affected by the occurrence of such driver account sales. The theories used in this research are the legal protection theory and the liability theory. The method applied in this study is a normative juridical approach, analyzed qualitatively based on legal theories and subsequently reviewed with the Consumer Protection Act and the Electronic Information and Transactions Act. The results of this study indicate that the practice of buying and selling Gojek driver accounts normatively violates several provisions in UUPK and UU ITE. In terms of consumer protection, this practice violates consumers' rights under Article 4 of UUPK regarding comfort, safety, and accurate information. Gojek, as a business operator, also violates its obligations under Article 7 of UUPK. This practice results in prohibited actions for business operators under Article 8 of UUPK, specifically providing services that do not meet standards and guarantees. This practice is also prohibited under Article 32 and Article 35 of UU ITE regarding the prohibition of transferring and altering electronic information. Gojek must be held responsible for this practice based on Article 19 of UUPK, which addresses consumer compensation, and Article 15 of UU ITE concerning responsibility for security in operating electronic systems and transactions. Gojek is expected to enhance its system security to provide reliable and safe service for consumers.
