            note = {Penelitian ini menganalisis Putusan Pengadilan Agama Tigaraksa Nomor 7091/Pdt.G/2022/Pa.Tgrs terkait sengketa hibah dalam konteks waris. Fokus utama pada penelitian ini adalah ketiadaan amar putusan mengenai pembatalan akta hibah yang menimbulkan ketidakpastian hukum. Tujuan penelitian ini adalah menganalisis pertimbangan hakim dan akibat hukum dari putusan tersebut. Metode yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan kasus. Penelitian ini menggunakan data primer dan data sekunder. Teknik pengumpulan data meliputi studi kepustakaan dan wawancara lapangan. Hasil penelitian menunjukkan bahwa Majelis Hakim dalam mempertimbangkan perkara hibah tidak hanya adil secara prosedural, melainkan juga menekankan pada keadilan substantif. Hal ini dapat dilihat dalam pertimbangan hukumnya Majelis Hakim merujuk pada prinsip keadilan dalam Islam, nilai-nilai keadilan dalam masyarakat, serta mempertimbangkan dampak emosional dan sosial dari putusan. Akibat hukumnya berdampak pada status sertifikat tanah, di mana ketiadaan putusan spesifik tentang pembatalan akta hibah dapat menghambat proses administrasi pertanahan untuk perubahan kepemilikan. Konsekuensinya, status quo sertifikat tanah berpotensi tetap berlaku meskipun objek hibah telah dinyatakan sebagai bagian dari harta warisan.},

        abstract = {This research examines the decision made by the Tigaraksa Religious Court with the reference number 7091/Pdt.G/2022/Pa.Tgrs. The case in question involves a dispute over a grant within the context of inheritance. The focus of the study is the absence of a clear decision regarding the cancellation of the grant deed, which has led to legal uncertainty. The aim of the research is to analyze the judge's reasoning and the legal implications of this decision. The research methodology employed is normative juridical, using a statutory and case-based approach and relying on both primary and secondary data. Data collection techniques include literature review and field interviews. The findings indicate that The Judges in considering grant cases is not only procedurally fair, but also emphasizes substantive justice. This can be seen in the legal considerations of the Panel of Judges referring to the principles of justice in Islam, the values of justice in society, as well as considering the emotional and social impact of the decision. The legal consequence impacts the status of the land certificate, as the lack of a specific decision on the cancellation of the grant deed may hinder the land administration process for ownership changes. As a result, the status of the land certificate may potentially remain valid even though the granted property has been declared part of the inheritance.},
