description: The Marriage Law, which is the basis for protecting the division of roles between  husband and wife in the context of marriage and has the character of gender  justice, actually provides space for gender injustice to occur. This is proven by the  fact that there are still articles in the Marriage Law that allow for different  interpretations, which can result in uncertainty or ambiguity in the division of  roles between husband and wife. Identify the problem in this research, How is the  division of roles between husband and wife in Article 31 paragraph (3) and  Article 34 of Law Number 16 of 2019 concerning Amendments to Law Number 1  of 1974 concerning Marriage in terms of gender equality? What is the form of  legal certainty regarding the division of roles between husband and wife in Law  Number 16 of 2019 concerning Amendments to Law Number 1 of 1974  concerning Marriage in order to realize gender equality? The theories used are  gender equality theory and legal certainty theory. The research method is  normative juridical. The research specifications used are analytical descriptive  research. The research results show that the division of roles between husband  and wife in Article 31 paragraph (3) and Article 34 of the Marriage Law is  dominated by traditional norms. The view that the husband is the main  breadwinner and the wife is the housekeeper often gives rise to injustice and  inequality, especially in terms of workload and economic contribution. The law  must encourage open communication and mutual agreement in the division of  roles and ensure that the protection of human rights, especially gender rights, is  clearly accommodated in the law.
