%X Marriage is a physical and spiritual bond between a man and a woman as husband and wife with the aim of creating a happy and eternal home based on the one and only God. The problem found in this research is how the biological father is responsible for the costs of living and educating children after divorce according to Law no. 16 of 2019 concerning Amendments to Law no. 1 of 1974 concerning Marriage and the Compilation of Islamic Law in Sanding Village, Petir District, Serang Regency, Banten and how to enforce the law against biological fathers who do not meet the costs of living and educating children after divorce according to Law no. 16 of 2019 concerning Amendments to Law no. 1 of 1974 concerning Marriage and the Compilation of Islamic Law in Sanding Village, Petir District, Serang Regency, Banten. The theories used in this research are the theory of the rule of law and the theory of legal certainty. The methods used in this research are normative juridical and empirical juridical methods. The normative juridical method is a method that only recognizes legal material and the empirical juridical method is research on social legal phenomena that exist in society. Analytical descriptive research type, analytical descriptive research type is a method that functions to describe or provide an overview of the research object. The conclusion from this research is that if a divorce occurs, the biological father is obliged to provide hadhanah costs for his child until the age of 21 years. The suggestion from this research is that government institutions in the field of marriage are expected to provide outreach to and for the community so that they can prepare themselves to learn to be good parents in accordance with applicable regulations.
%Z Perkawinan merupakan ikatan lahir batin antara pria dan wanita selaku suami istri dengan maksud mewujudkan rumah tangga yang bahagia serta kekal berlandaskan ketuhanan yang maha esa. Identifikasi masalah dalam penelitian ini yaitu bagaimana tanggung jawab ayah kandung terhadap biaya nafkah dan pendidikan anak pasca perceraian menurut UndangUndang No. 16 tahun 2019 tentang Perubahan Atas Undang-Undang No. 1 Tahun 1974 tentang Perkawinan dan Kompilasi Hukum Islam di Desa Sanding Kecamatan Petir Kabupaten Serang Banten dan bagaimana penegakan hukum terhadap ayah kandung yang tidak memenuhi biaya nafkah dan pendidikan anak pasca perceraian menurut  UndangUndang No. 16 Tahun 2019 tentang Perubahan Atas Undang-Undang No. 1 Tahun 1974 tentang Perkawinan dan Kompilasi Hukum Islam di Desa Sanding Kecamatan Petir Kabupaten Serang Banten. Teori yang digunakan pada penelitian ini adalah teori negara hukum dan teori kepastian hukum. Metode yang digunakan dalam penelitian ini adalah metode yuridis normatif dan yuridis empiris. Metode yuridis normatif adalah metode yang hanya mengenal bahan hukum dan yuridis empiris adalah penelitian fenomena hukum masyarakat yang terdapat dalam masyarakat. Jenis penelitian deskriptif analitis, jenis penelitian deskriptif analitis merupakan suatu metode yang berfungsi untuk mendeskripsikan atau memberi gambaran terhadap objek penelitian. Kesimpulan dari penelitian ini yaitu apabila terjadi perceraian maka ayah kandung wajib memberikan biaya hadhanah untuk anaknya sampai usia 21 tahun. Saran dari penelitian ini yaitu bagi lembaga pemerintahan di bidang perkawinan diharap agar bisa memberikan sosialisasi kepada masyarakat dan bagi masyarakat diharap bisa mempersiapkan diri untuk belajar menjadi orangtua yang baik sesuai dengan peraturan yang berlaku.
