The theories used in this research are the theory of the rule of law and the theory of legal certainty. The methods used in this research are normative juridical and empirical juridical methods. The normative juridical method is a method that only recognizes legal material and the empirical juridical method is research on social legal phenomena that exist in society. Analytical descriptive research type, analytical descriptive research type is a method that functions to describe or provide an overview of the research object. The conclusion from this research is that if a divorce occurs, the biological father is obliged to provide hadhanah costs for his child until the age of 21 years. The suggestion from this research is that government institutions in the field of marriage are expected to provide outreach to and for the community so that they can prepare themselves to learn to be good parents in accordance with applicable regulations.
