      "abstract": "Undang-Undang Dasar  Negara Republik Indonesia Tahun 1945 menjamin hak \r\npolitik warga negara dalam pemilihan umum termasuk pemilihan kepala daerah\r\n(Pilkada), yakni hak untuk memilih dan dipilih merupakan hak yang dijamin dalam\r\nUUD 1945. Hal itu sebagaimana ditegaskan dalam UUD 1945 Pasal 28D ayat (3)\r\nbahwa “Setiap warga negara berhak memperoleh kesempatan yang sama dalam\r\npemerintahan”, Pasal 18 ayat (4) “Gubernur, Bupati, dan walikota masing-masing\r\nsebagai kepala pemerintahan daerah provinsi, kabupaten dan kota dipilih secara\r\ndemokratis”, Begitupun dengan Pengakuan hak politik juga diakui dalam UndangUndang\r\nNomor\r\n12\r\nTahun\r\n2005 Tentang\r\nPengesahan\r\nInternational\r\nConvenant\r\nOn Civil\r\n\r\nand\r\n\r\nPolitical Hak-Hak Sipil dan Politik. Dalam penelitian ini terdiri dari dua (2)\r\nIdentifikasi masalah: (1) bagaimana hak pencalonan mantan terpidana korupsi untuk\r\nmencalonakan diri sebagai kepala daerah pasca putusan mahkamah konstitusi\r\nNo.56\/PUU-XVII\/2019, (2) Bagaimana hak konstitusional mantan terpidana korupsi\r\nuntuk dipilih sebagai kepala daerah menurut UUD 1945. \r\nPenelitian ini menggunakan metode yuridis normatif dengan jenis Penelitian \r\nKualitatif. Jenis data yang digunakan yakni data sekunder dan data primer dengan\r\nteknik pengumpulan data studi pustaka. Selanjutnya data dianalisis normatif kualitatif.\r\nPenelitian ini dilakukan dibeberapa lokasi yaitu: Perpustakaan Universitas Sultan\r\nAgeng Tirtayasa, Perpustakaan Fakultas Hukum Universitas Sultan Ageng Tirtayasa,\r\ndan Perpustakaan Daerah Provinsi Banten.  \r\nBerdasarkan hasil penelitian, dapat diketahui bahwa: bagi mantan terpidana \r\nkorupsi untuk mencalonkan diri sebagai kepala daerah memerlukan persyaratan yakni:\r\nbagi calon kepala daerah yang telah selesai menjalani masa pidana diharuskan\r\nmenunggu waktu selama 5 (lima) tahun untuk dapat mengajukan diri sebagai calon\r\nkepala daerah, kecuali terhadap calon kepala daerah yang melakukan tindak pidana\r\nkealpaan dan tindak pidana politik dalam pengertian suatu perbuatan yang dinyatakan\r\nsebagai tindak pidana dalam hukum positif hanya karena pelakunya mempunyai\r\npandangan politik yang berbeda dengan rezim yang sedang berkuasa. Hak pencalonan\r\nmantan terpidana korupsi mestinya berpegang teguh pada prinsip keadilan dan hak\r\nasasi manusia dalam konstitusi.",

      "note": "The Constitution Republic Indonesia of 1945 guarantees the political rights of citizens \r\nin general elections including regional head elections (Pilkada), namely the right to vote and\r\nbe elected is a right guaranteed in the 1945 Constitution. This is as confirmed in the 1945\r\nConstitution Article 28D paragraph (3) that \" Every citizen has the right to equal\r\nopportunities in government \", Article 18 paragraph (4)\" Governors, Regents, and mayors\r\nrespectively as heads of provincial, regency and municipal government are elected\r\ndemocratically \", Likewise, the recognition of political rights is also recognized in Law\r\nNumber 12 of 2005 concerning Ratification of International Convenant On Civil and Political\r\nCivil and Political Rights. This research consists of two (2) problem identification: (1) what is\r\nthe candidacy rights of former corruption convicts to run for regional heads after the decision\r\nof the constitutional court No.56 \/ PUU-XVII \/ 2019, (2) What is the constitutional rights of\r\nformer corruption convicts to be elected as a regional head according to the 1945\r\nConstitution. \r\nThis study uses a normative juridical method with qualitative research type. \r\nTypes of data used are secondary data and primary data with literature study data\r\ncollection techniques. Furthermore, the data were analyzed normatively qualitative.\r\nThis research was conducted in several locations, namely: Sultan Ageng Tirtayasa\r\nUniversity Library, Sultan Ageng Tirtayasa University Law Library, and Banten\r\nProvincial Library. \r\nBased on the results of the research, it can be seen that: for former corruption \r\nconvicts to run for regional head candidates require requirements, namely: for\r\nregional head candidates who have completed their criminal period are required to\r\nwait 5 (five) years to be able to apply for regional head candidates, except for a\r\ncandidate for regional head who commits a crime of negligence and a political crime\r\nin the sense of an act which is declared a criminal offense in positive law only because\r\nthe perpetrator has a different political view from the regime in power. The right to\r\nnominate former corruption convicts must adhere to the principles of justice and\r\nhuman rights in the constitution. \r\nKeywords: Candidacy Rights, Former Corruption Convict, Regional Head Election.",
