      "abstract": "Perusahaan asuransi yang seharusnya menjadi penjamin kerugian yang di alami\r\noleh tertanggung justru tidak dilakukan dengan dasar dan ketentuan hukum\r\nasuransi dalam kasus ini adalah perkara Perusahaan Asuransi dengan Penumpang\r\nyang bernamakan Mugiyat. Dari hasil penelitian didapati kasus penyelesaian\r\nklaim asuransi yang tidak sesuai dengan ketentuan hukum yang dilakukan oleh\r\npihak pengusaha kepada penumpang, dimana dalam pemberian uang kerugian\r\nklaim asuransi tidak sesuai dengan ketentuan hukum yang berlaku. Berdasarkan\r\nlatar belakang tersebut Peneliti mengkaji bagaimana tanggung jawab hukum PT.\r\nAsuransi Jasa Raharja terhadap penumpang jasa angkutan air yang mengalami\r\nkecelakaan di kapal laut ditinjau dari Undang-Undang Nomor 33 tahun 1964\r\ntentang Dana Pertanggungan Wajib Penumpang. Metode penelitian yang\r\ndigunakan adalah metode kualitatif dengan jenis penelitian yuridis normatif.\r\nSumber data yang digunakan adalah data sekunder dengan data primer sebagai\r\npenunjang berupa wawancara. Hasil penelitian ini menunjukkan bahwa bahwa\r\nPT. Jasaraharja Putera dalam penyelesaian ganti rugi tersebut hanya\r\nmementingkan sepihak saja yaitu kepentingan pihak penanggung tanpa\r\nmemikirkan risiko tertanggung. Kekurangan pembayaran ganti rugi terhadap\r\npihak tertanggung yang tidak dibayarkan oleh PT. Jasaraharaja Putera berakibat\r\nPT. Jasaraharaja Putera telah melawan hukum dengan melanggar Pasal 28\r\nUndang-Undang Perasuransian yang menyebutkan Perusahaan Asuransi,\r\nPerusahaan Asuransi Syariah, Perusahaan Reasuransi, Perusahaan Reasuransi\r\nSyariah dilarang melakukan tindakan yang dapat memperlambat penyelesaian\r\natau pembayaran klaim, atau tidak melakukan tindakan yang seharusnya\r\ndilakukan sehingga mengakibatkan keterlambatan penyelesaian atau pembayaran\r\nklaim dan akibat tindakan tersebut perusahaan asuransi dapat dikenakan sanksi\r\nadministratif berupa peringatan tertulis dilakukan paling banyak 3 (tiga) kali\r\nberturut-turut atas setiap pelanggaran. Jangka waktu pemberlakuan sanksi\r\nadministratif berupa peringatan tertulis bagi Perusahaan Asuransi masing-masing\r\npaling lama 30 (tiga puluh) hari sejak ditetapkannya sanksi administratif tersebut.\r\nPerusahaan Asuransi akan dikenai sanksi administratif berupa pembatasan\r\nkegiatan usaha. Apabila dengan dikenakannya sanksi pembatasan kegiatan usaha\r\nuntuk seluruh kegiatan usaha tetapi Perusahaan Asuransi masih tidak dapat\r\nmengatasi pelanggaran yang ada barulah sanksi terberat yang akan dikenakan\r\nyaitu pencabutan izin usaha Perusahaan Asuransi tersebut.",

      "note": "The insurance company which is supposed to be the guarantor of the loss suffered\r\nby the insured is not carried out on the basis and provisions of the insurance law.\r\nIn this case, the case of the Insurance Company with a Passenger named Mugiyat.\r\nFrom the results of the research, it was found that cases of insurance claim\r\nsettlement that were not in accordance with legal provisions carried out by the\r\nemployer to passengers, where the provision of insurance claim loss money was\r\nnot in accordance with applicable legal provisions. Based on this background, the\r\nresearcher examines how the legal responsibility of PT. Jasa Raharja Insurance\r\nfor water transportation service passengers who have an accident on a ship is\r\nreviewed from Law Number 33 of 1964 concerning Compulsory Passenger\r\nInsurance Funds. The research method used is a qualitative method with\r\nnormative juridical research. The data source used is secondary data with\r\nprimary data as a support in the form of interviews. The results of this study\r\nindicate that PT. Jasaraharja Putera in settling the compensation only\r\nemphasizes one-sidedly, namely the interests of the insurer without considering\r\nthe insured's risk. Lack of compensation payments to the insured that was not paid\r\nby PT. Jasaraharaja Putera resulted in PT. Jasaraharaja Putera has violated the\r\nlaw by violating Article 28 of the Insurance Law which states that the Insurance\r\nCompany, Sharia Insurance Company, Reinsurance Company, Sharia\r\nReinsurance Company is prohibited from taking any action that can delay the\r\nsettlement or payment of claims, or not taking actions that should be done\r\nresulting in delays in settlement or payment of claims and the consequence of\r\nsuch action the insurance company may be subject to administrative sanctions in\r\nthe form of a written warning made at most 3 (three) consecutive times for each\r\nviolation. The period for the imposition of administrative sanctions in the form of\r\na written warning for each Insurance Company is no later than 30 (thirty) days\r\nafter the stipulation of the administrative sanctions. Insurance companies will be\r\nsubject to administrative sanctions in the form of restrictions on business\r\nactivities. If the imposition of sanctions for limiting business activities for all\r\nbusiness activities but the Insurance Company is still unable to overcome existing\r\nviolations, then the heaviest sanction will be imposed, namely the revocation of\r\nthe Insurance Company's business license.",
