Penelitian ini merupakan jenis penelitian kumulatif dengan metode pendekatan yuridis normatif, data yang digunakan adalah data sekunder berupa data kepustakaan dengan tiga bahan hukum yaitu bahan primer, bahan hukum sekunder dan bahan hukum tersier, kemudian dianalisis secara deskriptif analisis. Berdasarkan hasil analisis dan pembahasan, diperoleh kesimpulan kedudukan TAP MPRS Nomor XXV/MPRS/1966 yang berkaitan dengan larangan ajaran komunis dan partai komunis Indonesia (PKI). Ketetapan MPRS ini tidak menghambat kemerdekaan pikiran baik secara lisan maupun tulisan, karena TAP MPRS Nomor XXV/MPRS/1966 ini hanya melarangan kegiatan-kegiatan menyebarkan paham komunisme.K Law (General)2020UNIVERSITAS SULTAN AGENG TIRTAYASA;FAKULTAS HUKUMThesis
