Abstract

Insurance companies are companies that act as risk insurers. Insurance companies are companies that act as risk insurers. The ability of an insurance company to assume a guaranteed risk depends on its financial strength. The offer of insurance products is done in several ways, among others: First done through face-to-face or face to face with the customers themselves, Secondly, which currently has the opportunity to cause legal problems in the future ie offer by phone or often called in the business world is Telemarketing (supply / Product marketing by phone). This research is conducted to know and analyze the protection of insurance agreement law through telemarketing in terms of Electronic Information and Transaction Law and OJK (Financial Service Authority) regulation and to know legal settlement for business actor and consumer in case of wanprestation in Insurance agreement through telemarketing. To be analyzed by qualitative analysis, that is qualitative analysis which is used for normative aspects (juridical) through descriptive method of analysis. The results showed that the insurance agreement through telemarketing has been detailed regulated in legislation both legal protection, rights and obligations as well as legal settlement for business actors and insurance customers. Additional Information: Perusahaan asuransi adalah perusahaan yang bertindak sebagai penanggung risiko. Kemampuan perusahaan asuransi untuk menanggung suatu risiko yang dijaminnya tergantung kepada kekuatan keuangan yang dimilikinya. Penawaran produk asuransi dilakukan dalam beberapa cara, antara lain : Pertama dilakukan melalui tatap muka ataupun berhadapan secara langsung dengan nasabah sendiri, Kedua yang saat ini berpeluang menimbulkan terjadinya permasalahan hukum dikemudian hari yaitu penawaran melalui telepon atau sering disebut di dunia bisnis adalah Telemarketing (penawaran/pemasaran produk lewat telepon). Penelitian ini dilakukan untuk mengetahui dan menganalisis perlindungan hukum perjanjian asuransi melalui telemarketing ditinjau dari Undang-undang Informasi dan Transaksi Elektronik dan peraturan OJK (Otoritas Jasa Keuangan) serta untuk mengetahui penyelesaian hukum bagi pelaku usaha dan konsumen bila terjadi wanprestasi dalam perjanjian asuransi melalui telemarketing. Jenis penelitian yang digunakan peneliti adalah dengan menggunakan penelitian hukum normatif, dengan pendekatan undang-undang (statute approach) yang mengatur tentang kedudukan hukum perjanjian yang dilakukan melalui telemarketing, datadata tersebut dikumpulkan melalui penelusuran kepustakaan (Library Research) untuk memperoleh bahan hukum primer, bahan hukum sekunder, serta bahan hukum tertier dengan teknik pengumpulan data studi dokumen dengan mempelajari, mengkaji, dan menelaah materi/bahan-bahan hukum, baik yang berupa peraturan perundang-undangan, buku-buku literatur, makalah, artikel, hasil penelitian, dan karya ilmiah lainnya. Yang akan dianalisis dengan cara analisis kualitatif, yaitu analisis kualitatif yang dipergunakan untuk aspek-aspek normatif (yuridis) melalui metode yang bersifat deskriptif analisis. Hasil penelitian menunjukan bahwa perjanjian asuransi melalui telemarketing sudah secara rinci diatur dalam peraturan perundang-undangan baik perlindungan hukum, hak dan kewajiban serta penyelesian hukum bagi pelaku usaha dan nasabah asuransinya.
