Abstract
ABSTRACT THE POSITION OF DEPUTY MINISTER OF THE MINISTRY OF STATE ORGANIZATION BASED ON LEGAL NO. 39 OF 2008 ABOUT MINISTRIES In the organizational structure of the Ministry of the country there is the Office of the Deputy Minister under Section 10 of the Legal Number 39 in 2008 about ministries. Based on those questions, identified two issues of concern to this thesis, as follows: first, how the position of Deputy Secretary in the State Ministry Organization according to Legal No. 39 of 2008? Second, how the legal relations resulting from the Deputy Minister and the Minister in the execution of the tasks of the Ministry? My Used Method is With Normative Juridical Method as the primary method, i.e. the research by examining secondary data obtained from the study of librarianship and the positive law in force. The approach in this study is an approach to legal principles, with the source data obtained from secondary data composed of primary legal materials, legal materials and legal materials tertiary secondary which is then analyzed data in Descriptive Analysis Method. Of research results obtained among other conclusions : first, the position of Deputy Secretary in the Ministry of Organization according to the provisions of article 10 Legal No. 39 of 2008 About Ministries regarding the Office of the Deputy Minister that the Deputy Minister tasked to assist the Minister in carrying out the tasks of daily Government in case there is a workload that requires a Ministry specifically handling and is responsible to the Minister. Second, the legal consequences of the relationship of the Minister and Deputy Minister in the Ministry of the organizational structure of the country as defined in article 11 and 12 of the regulation President Number 60 in 2012 about Deputy Minister, stated that the Deputy Minister is obligated to coordinate with the Minister, namely establishing harmony with the policy of Minister, following and obeying the instructions of the Minister and submit a report of the results of the implementation of its duties to the Minister. Berdasarkan pertanyaan-pertanyaan tersebut, teridentifikasi ada dua masalah yang menjadi perhatian tesis ini, sebagai berikut : Pertama, bagaimana kedudukan Wakil Menteri dalam Susunan Organisasi Kementerian Negara menurut Undang-Undang Nomor 39 Tahun 2008 ? Kedua, bagaimana akibat hukum hubungan Wakil Menteri dan Menteri dalam Pelaksanaan Tugas Kementerian ? Metode yang Penulis gunakan adalah dengan Metode Yuridis Normatif sebagai Metode Utama, yakni penelitian dengan mengkaji data sekunder yang diperoleh dari studi kepustakaan dan hukum positif yang berlaku. Pendekatan dalam penelitian ini adalah Pendekatan Asas-Asas Hukum, dengan Sumber data yang diperoleh dari data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier yang kemudian dianalisis data secara Metode Deskriptif Analisis. Dari hasil penelitian diperoleh kesimpulan sebagai berikut : Pertama, kedudukan Wakil Menteri dalam Susunan Organisasi Kementerian menurut ketentuan Pasal 10 Undang-Undang Nomor 39 Tahun 2008 Tentang Kementerian Negara mengenai jabatan Wakil Menteri bahwa Wakil Menteri bertugas untuk membantu Menteri dalam menjalankan tugas-tugas pemerintahan sehari-hari dalam hal ada beban kerja kementerian yang membutuhkan penanganan secara khusus dan bertanggung jawab kepada Menteri. Kedua, akibat hukum dari hubungan Menteri dan Wakil Menteri dalam Struktur Organisasi Kementerian Negara seperti yang ditegaskan dalam Pasal 11 dan Pasal 12 Peraturan Presiden Nomor 60 Tahun 2012 tentang Wakil Menteri, menyatakan bahwa Wakil Menteri wajib berkoordinasi dengan Menteri, yaitu membangun keselarasan dengan kebijakan Menteri, mengikuti dan mematuhi petunjuk Menteri dan menyampaikan Laporan Hasil pelaksanaan tugasnya kepada Menteri.
