Abstract

The beauty industry in Indonesia faces serious challenges from the circulation of illegal cosmetics that endanger consumers. These products often contain prohibited substances such as mercury and hydroquinone, which have been proven to cause severe physical and health damage to consumers. Therefore, the researcher identifies two main problems, first, how criminal law enforcement is carried out against the trade of illegal cosmetics in Indonesia, second, what protection efforts can be applied for victims of illegal cosmetic trade crimes based on Law Number 8 of 1999 concerning Consumer Protection. The theories used in this study are the theory of law enforcement and the theory of legal protection, employing a normative juridical research method and a statutory approach. The results of the study indicate that legal protection for victims of illegal cosmetic trade crimes has not been optimally fulfilled. Although Law Number 8 of 1999 concerning Consumer Protection clearly regulates legal remedies available to victims, the implementation of these regulations remains weak. This is due to several factors, such as limited law enforcement resources and the lack of public awareness regarding their rights as consumers. Therefore, measures such as strengthening the capacity of law enforcement officers, expanding public education, and imposing stricter sanctions are necessary to ensure more effective consumer protection and to suppress the circulation of illegal cosmetics in Indonesia

Additional Information: Industri kecantikan di Indonesia menghadapi tantangan serius dari peredaran kosmetik ilegal yang membahayakan konsumen. Produk-produk ini seringkali mengandung bahan terlarang seperti merkuri dan hidrokuinon, yang telah terbukti menimbulkan kerugian fisik dan kesehatan yang serius bagi konsumen. Dengan demikian, peneliti mengidentifikasi masalah yaitu, pertama, bagaimana penegakan hukum pidana dalam terhadap perdagangan kosmetik illegal di Indonesia, kedua, bagaimana upaya perlindungan yang dapat digunakan oleh korban tindak pidana perdagangan kosmetik illegal berdasarkan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Teori yang digunakan adalah teori penegakan hukum dan teori perlindungan hukum, dengan menggunakan metode penelitian yuridis normatif dan pendekatan perundang-undangan. Dari hasil penelitian menunjukan bahwa perlindungan hukum terhadap korban tindak pidana perdagangan kosmetik illegal belum terpenuhi secara optimal. Meskipun UndangUndang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen telah secara jelas mengatur bentuk pemulihan hukum bagi korban, namun implementasi regulasi tersebut masih lemah. Hal ini disebabkan oleh beberapa faktor, seperti keterbatasan sumber daya penegak hukum dan kurangnya pemahaman masyarakat mengenai hak-hak mereka sebagai konsumen. Oleh karena itu, diperlukan langkah-langkah seperti peningkatan kapasitas penegak hukum, edukasi publik yang lebih luas, dan penerapan sanksi yang lebih tegas untuk memastikan perlindungan konsumen yang lebih efektif dan menekan peredaran kosmetik ilegal di Indonesia
