Abstract
Workers have the right to receive protection, opportunity, and fair treatment in their employment relationship without discrimination. Especially pregnant female workers are vulnerable to discrimination. Pregnant female workers have very important maternity rights because they are directly related to the health, safety, and well-being of both mother and child. Maternity rights include leave for pregnancy, childbirth, menstruation, miscarriage, breastfeeding rights, work time protection, and protection from dismissal. Therefore, the company, as the employer, has a responsibility to its workforce in fulfilling their rights. Based on this background, it is necessary to study how gender justice is applied in fulfilling the maternity rights of pregnant female workers at PT. KINE Project, viewed in light of Law Number 13 of 2003 concerning Labor. And what are the legal efforts of workers and the responsibility of PT. KINE Project in fulfilling the maternity rights of pregnant female workers? The theories used in this study are gender theory and the theory of legal certainty. The method used is the empirical juridical method. In this approach, researchers use legal data sources, including primary law such as statutes and regulations, and focus on collecting and analyzing data that is tangible and observable. The results of this study indicate that pregnant female workers are entitled to their maternity rights as a form of gender justice within the company. PT. KINE Project has not been fully realized across the board, as there are still disparities in the fulfillment of maternity rights for pregnant female workers. Normatively, the company has complied with the provisions of Law Number 13 of 2003 concerning Manpower. The absence of legal remedies for female workers. When their maternity rights are not fulfilled due to a lack of knowledge or the absence of socialization regarding maternity rights of workers, this indicates a gap between legal provisions and the reality on the ground. The Company's responsibility in the PT. KINE Project has not been implemented optimally due to the lack of facilities that support the maternity rights of female workers.

| Additional Information: | Tenaga kerja memiliki hak untuk memperoleh perlindungan, kesempatan, dan perlakuan adil dalam hubungan kerja tanpa diskriminasi. Khususnya tenaga kerja perempuan hamil yang rentan dari diskriminasi. Tenaga kerja perempuan hamil memiliki hak maternitas yang sangat penting karena berkaitan langsung dengan kesehatan, keselamatan, serta kesejahteraan ibu dan anak. Hak maternitas meliputi cuti hamil, melahirkan, menstruasi, keguguran, hak menyusui, perlindungan waktu kerja, dan perlindungan dari pemutusan hubungan kerja. Maka, perusahaan sebagai pemberi kerja memiliki tanggung jawab kepada tenaga kerja dalam pemenuhan hak tenaga kerja. Berdasarkan latar belakang tersebut perlu dikaji tentang bagaimana keadilan gender dalam pemenuhan hak maternitas tenaga kerja perempuan hamil di PT. KINE Project ditinjau dengan Undang-Undang Nomor 13 tahun 2003 tentang Ketenagakerjaan? Dan bagaimana upaya hukum pekerja dan tanggung jawab PT. KINE Project dalam pemenuhan hak maternitas tenaga kerja perempuan hamil?. Teori yang digunakan pada penelitian ini adalah teori gender dan teori kepastian hukum. Metode yang digunakan adalah metode yuridis empiris. Dalam pendekatan ini, peneliti menggunakan sumber data hukum, baik hukum primer seperti undang-undang, peraturan, dan berfokus pada pengumpulan dan hasil analisis data yang bersifat nyata dan terobservasi. Hasil penelitian ini menunjukkan bahwa tenaga kerja perempuan hamil berhak mendapatkan hak maternitasnya sebagai bentuk keadilan gender dalam perusahaan. PT. KINE Project belum sepenuhnya terwujud secara menyeluruh, karena masih terdapat ketimpangan dalam pemenuhan hak-hak maternitas tenaga kerja perempuan hamil. Secara normatif, perusahaan telah menjalankan sebagian ketentuan Undang-Undang Nomor 13 tahun 2003 tentang Ketenagakerjaan. Tidak ditemukannya upaya hukum pekerja perempuan ketika hak maternitasnya tidak terpenuhi karena minimnya pengetahuan atau tidak adanyan sosialisasi terkait hak maternitas tenaga kerja, hal ini menunjukan adanya kesenjangan antara ketentuan hukum dan kenyataan dilapangan. Tanggung jawab perusahaan di PT. KINE Project ini belum terlaksana secara optimal karena tidak tersedianya fasilitas yang mendukung hak maternitas tenaga kerja perempuan. | |||||||||
