Abstract
The trademark holder has exclusive rights that prohibit other parties from using their trademark without permission, so the act of using someone else's trademark is an unlawful act. Logos are one of the objects protected by trademarks, therefore logos cannot be uploaded carelessly without the owner's permission, even on social media. However, the opposite was done by Vicky Kalea who uploaded Indosiar's logo to his social media in order to parody one of the programs broadcast by the Indosiar television station. The use of the logo without permission certainly caused losses for Indosiar, therefore Indosiar decided to take legal action against this case. The purpose of this study is to analyze the law enforcement against the use of the Indosiar logo in social media content based on Law Number 20 of 2016 concerning Trademarks and Geographical Indications and the implementation of sanctions. The theory used in this study is the theory of law enforcement. The method used is the normative juridical method with the type of research being qualitative research. The approach method used is a legislative, conceptual, and case approach using secondary data types originating from primary to tertiary legal sources. The results of the study show that (1) The parties, namely Indosiar and Vicky Kalea, agreed to enforce the law through mediation, which is an alternative form of dispute resolution outside the courts. Mediation was chosen after Indosiar previously reported Vicky Kalea to the West Jakarta Metro Police for alleged violation of Article 100 paragraph (1) of Law Number 20 of 2016 concerning Trademarks and Geographical Indications, but at Vicky Kalea's request and in order to respect the police's commitment to seek a resolution by upholding restorative justice, law enforcement did not go to court but was completed at the mediation stage; and (2) The sanctions imposed on Vicky Kalea are non-formal sanctions that are not explicitly regulated in the Trademark Law, namely a statement of apology at a press conference held by the West Jakarta Metro Police on November 27, 2023. The imposition of this sanction restores Indosiar's good name and is evidence of a peaceful settlement from mediation.

| Additional Information: | Pemegang hak atas merek memiliki hak eksklusif yang melarang pihak lain untuk menggunakan merek miliknya tanpa izin, sehingga perbuatan menggunakan merek milik orang lain adalah perbuatan yang melanggar hukum. Logo termasuk salah satu objek yang dilindungi oleh merek, oleh sebab itu logo juga tidak boleh diunggah sembarangan tanpa seizin dari pemiliknya, sekalipun dilakukan di media sosial. Namun hal sebaliknya justru dilakukan oleh Vicky Kalea yang mengunggah logo milik Indosiar ke media sosial miliknya dalam rangka memarodikan salah satu acara yang disiarkan oleh stasiun televisi Indosiar tersebut. Penggunaan logo tanpa izin ini tentu saja menimbulkan kerugian bagi pihak Indosiar, oleh sebab itu pihak Indosiar memutuskan untuk menempuh jalur hukum terhadap kasus ini. Tujuan dilakukannya penelitian ini adalah untuk menganalisis penegakan hukum terhadap penggunaan logo Indosiar pada konten media sosial berdasarkan Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis beserta pelaksanaan sanksinya. Teori yang digunakan dalam penelitian kali ini adalah teori penegakan hukum. Metode yang digunakan adalah metode yuridis normatif dengan jenis penelitiannya adalah penelitian kualitatif. Metode pendekatan yang digunakan adalah pendekatan perundang-undangan, konseptual, dan kasus dengan menggunakan jenis data sekunder yang berasal dari sumber hukum primer hingga tersier. Hasil penelitian menunjukkan bahwa (1) Para pihak yaitu Indosiar dan Vicky Kalea sepakat untuk melaksanakan penegakan hukum melalui mediasi yang merupakan salah satu bentuk alternatif penyelesaian sengketa di luar pengadilan. Mediasi dipilih setelah sebelumnya pihak Indosiar melaporkan Vicky Kalea ke Polres Metro Jakarta Barat atas dugaan pelanggaran Pasal 100 ayat (1) Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis, namun atas permintaan Vicky Kalea dan demi menghormati komitmen pihak kepolisian untuk mengupayakan penyelesaian dengan menjunjung keadilan restoratif maka penegakan hukum tidak sampai masuk ke jalur pengadilan melainkan selesai pada tahap mediasi; dan (2) Sanksi yang dijatuhkan terhadap Vicky Kalea adalah sanksi non-formal yang tidak diatur secara eksplisit di dalam UU Merek yaitu adanya pernyataan maaf dalam konferensi pers yang diselenggarakan oleh Polres Metro Jakarta Barat pada tanggal 27 November 2023. Adanya penjatuhan sanksi ini memulihkan nama baik Indosiar serta bukti penyelesaian damai dari mediasi. | |||||||||
