Abstract
This study aims to provide an in-depth analysis of the role and responsibilities of the Social Service Office of Serang City in fulfilling mental health services for Persons with Mental Disorders (ODGJ) as mandated by Law Number 17 of 2023 on Health. The research responds to the increasing number of neglected ODGJ cases in recent years, the limited availability of mental health facilities at the regional level, and the ongoing gaps between the constitutional and statutory guarantees of mental health rights and their actual implementation. Although the rights of persons with mental disorders are protected under the Indonesian Constitution, the Human Rights Law, and the most recent national health legislation, the reality shows significant discrepancies between legal mandates and local practices. Based on the theory of state responsibility and legal protection, the state is obligated to guarantee the health right of its citizen in a manner that is fair, certain, and accountable. An empirical legal research method with a qualitative and phenomenological approach was employed to capture the perspectives and lived experiences of stakeholders involved in mental health services. Data were collected through in-depth interviews, field observations, and a review of institutional documents from the Social Service Office of Serang City. The findings reveal that the Office has undertaken several key functions, including biometric identification of ODGJ, collaboration with partner institutions for treatment, social assistance, and referral to medical services. However, the implementation remains suboptimal due to budget constraints, the absence of a dedicated shelter, limited availability of professional social workers, and persistent social stigma toward persons with mental disorders. Furthermore, intersectoral coordination among health services, local government units, law enforcement, and community organizations is still fragmented, resulting in less comprehensive and slower responses to ODGJ-related issues. The scarcity of updated data and academic studies on mental health conditions in Serang City during the last three years underscores the urgency of this research. This study thus offers substantive academic contributions by presenting a comprehensive overview of existing challenges and proposing evidence-based recommendations to enhance the effectiveness, sustainability, and inclusiveness of local mental health governance.

| Additional Information: | Fokus penelitian ini dilatarbelakangi oleh meningkatnya jumlah ODGJ terlantar dalam beberapa tahun terakhir, minimnya fasilitas pendukung kesehatan jiwa di tingkat daerah, serta belum optimalnya implementasi kebijakan kesehatan jiwa yang seharusnya dilaksanakan pemerintah daerah. Penelitian ini bertujuan untuk menganalisis secara mendalam peran dan tanggung jawab Dinas Sosial Kota Serang dalam pemenuhan kesehatan jiwa bagi Orang dengan Gangguan Jiwa (ODGJ) berdasarkan Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan. Meskipun hak ODGJ telah dijamin sepenuhnya dalam Undang-Undang Dasar Negara Republik Indonesia Tahun 1945, Undang-Undang Nomor 39 Tahun 1999 tentang Hak Asasi Manusia, dan regulasi kesehatan terbaru, kenyataannya masih ditemukan kesenjangan antara norma hukum dan praktik lapangan. Berdasarkan teori tanggung jawab negara dan teori perlindungan hukum, negara wajib menjamin hak kesehatan warga secara adil, pasti, dan bertanggung jawab. Penelitian ini menggunakan metode penelitian hukum empiris dengan pendekatan kualitatif dan fenomenologi untuk memahami fenomena kesehatan jiwa dari perspektif para pemangku kepentingan. Data diperoleh melalui wawancara mendalam, observasi lapangan, serta penelusuran dokumen pendukung di Dinas Sosial Kota Serang. Hasil penelitian menunjukkan bahwa Dinas Sosial telah menjalankan sejumlah fungsi penting seperti pendataan ODGJ menggunakan biometrik, koordinasi dengan lembaga mitra untuk perawatan, pendampingan sosial, dan rujukan pengobatan. Namun, pelaksanaannya belum berjalan optimal karena keterbatasan anggaran, belum tersedianya rumah singgah khusus bagi ODGJ, kurangnya tenaga pendamping profesional, serta masih kuatnya stigma masyarakat terhadap ODGJ. Selain itu, koordinasi lintas sektor baik dengan layanan kesehatan, kepolisian, maupun pemerintah kelurahan belum terjalin secara sistematis sehingga menghambat proses penanganan komprehensif. Minimnya data dan penelitian terkait kondisi kesehatan jiwa di Kota Serang, terutama dalam kurun waktu tiga tahun terakhir, semakin mempertegas pentingnya penelitian ini sebagai kontribusi akademik yang dapat menjadi dasar dalam penyusunan kebijakan berbasis bukti (evidence-based policy). Penelitian ini diharapkan dapat memberikan gambaran komprehensif mengenai kondisi aktual pelaksanaan perlindungan kesehatan jiwa dan menawarkan rekomendasi strategis agar pemerintah daerah dapat memenuhi kewajibannya secara lebih efektif, berkelanjutan, dan sesuai prinsip non-diskriminasi. | |||||||||
