Abstract

This study departs from the gap between the sharp increase in cyberbullying cases facilitated by social media and the relatively slow and ineffective legal response in practice. Social media, through its features of anonymity, flexible identity, and the rapid dissemination of content, has created structural conditions that intensify bullying behavior. This phenomenon raises two key issues: how social media shapes the factors that drive individuals to commit cyberbullying, and how preventive efforts against cyberbullying can be optimized on social media platforms. To address these questions, the research employs a qualitative, normative juridical approach, drawing on secondary data (the Information and Electronic Transactions Law, the Indonesian Criminal Code, and relevant Joint Decrees) and primary data obtained from interviews with the Cyber Unit of the Banten Regional Police. The analysis is grounded in Space Transition Theory to explain the behavioral transformation of perpetrators, and Deterrence Theory to assess the effectiveness of sanctions. The findings show that social media functions as both facilitator and psychological accelerator: its anonymity lowers moral inhibitions and triggers the release of momentary emotions and latent aggression (internal causal factors) in line with Space Transition Theory. At the same time, existing regulatory prevention efforts are rendered less effective because platform structures undermine the certainty and celerity of sanctions central to Deterrence Theory, mainly due to difficulties in identifying anonymous perpetrators and slow legal procedures. The study concludes that effective prevention requires an integrated operational protocol binding regulators, law enforcement, and platforms. It recommends that platforms adopt multi-level identity verification to reduce anonymity and provide integrated reporting channels that ensure swift handling and preservation of digital evidence before content is removed, thereby strengthening legal certainty and deterrence.

Additional Information: Penelitian ini berangkat dari adanya kesenjangan antara lonjakan kasus cyberbullying yang difasilitasi oleh media sosial dengan efektivitas penindakan hukum yang lambat di lapangan. Media sosial, dengan fitur anonimitas, fleksibilitas identitas, dan kecepatan penyebaran konten, telah menciptakan kondisi struktural yang memperburuk perilaku perundungan. Fenomena ini menimbulkan dua masalah pokok yaitu bagaimana peran media sosial memengaruhi faktor-faktor penyebab seseorang melakukan cyberbullying dan bagaimana upaya pencegahan kasus cyberbullying dalam media sosial. Untuk menganalisis masalah ini, penelitian menggunakan pendekatan kualitatif-yuridis normatif, didukung oleh data sekunder (UU ITE, KUHP, SKB) dan data primer dari wawancara dengan unit siber Kepolisian Daerah Banten. Analisis berlandaskan pada Teori Transisi Ruang (Space Transition Theory) untuk menjelaskan transformasi perilaku pelaku, dan Teori Pencegahan (Deterrence Theory) untuk mengevaluasi efektivitas sanksi. Hasil penelitian menunjukkan bahwa media sosial berperan sebagai fasilitator dan akselerator psikologis, dimana anonimitasnya menurunkan hambatan moral yang memicu pelampiasan emosi sesaat dan agresi tertahan (faktor penyebab internal) sesuai dengan Teori Transisi Ruang. Sementara itu, upaya pencegahan regulatif yang sudah ada menjadi tidak efektif karena platform menciptakan hambatan struktural yang meruntuhkan pilar kepastian (certainty) dan kecepatan (celerity) sanksi dalam Teori Pencegahan, yang dipicu oleh sulitnya identifikasi pelaku anonim dan lambatnya prosedur hukum. Disimpulkan bahwa upaya pencegahan yang efektif menuntut protokol kerja terpadu yang mengikat regulator, penegak hukum, dan platform. Oleh karena itu, disarankan agar platform menerapkan verifikasi identitas bertingkat untuk menekan anonimitas serta menyediakan kanal pelaporan terpadu yang menjamin kecepatan penanganan dan pelestarian bukti digital (jejak digital) sebelum konten dihapus, demi memperkuat kepastian hukum (deterrence).
