Abstract
Kekhawatiran terhadap perlindungan konsumen di industri air minum isi ulang, khususnya di wilayah Rangkasbitung, semakin meningkat akibat maraknya pelanggaran standar kualitas. Padahal, perlindungan konsumen merupakan hak dasar yang dijamin oleh Undang-Undang Nomor 8 Tahun 1999. Sayangnya, lemahnya pengawasan, pelaksanaan regulasi yang belum optimal, serta rendahnya kesadaran dari pihak konsumen maupun pelaku usaha membuat pelanggaran tersebut terus terjadi. Konsumen kerap tidak memperoleh informasi yang benar, produk yang aman, maupun kompensasi atas kerugian yang dialami. Di sisi lain, pelaku usaha cenderung mengabaikan tanggung jawab mereka dalam menjamin mutu dan menyampaikan informasi secara jujur. Penelitian ini bertujuan untuk menganalisis bentuk perlindungan hukum bagi konsumen air minum isi ulang di Rangkasbitung berdasarkan UU No. 8 Tahun 1999, serta meninjau akuntabilitas pelaku usaha, khususnya pada Depot Air Minum Isi Ulang Alika, dalam menerapkan standar kualitas. Dengan pendekatan yuridis normative empiris, penelitian menggabungkan data sekunder dari peraturan, buku, dan jurnal, serta data primer dari wawancara dengan teori perlindungan hukum dan tanggungjawab hukum. Hasilnya menunjukkan bahwa perlindungan hukum belum berjalan efektif. Depot seperti Alika tidak konsisten menjalankan standar kualitas, termasuk tidak melakukan uji laboratorium rutin, yang berdampak pada kerugian konsumen. Kurangnya akuntabilitas ini umumnya disebabkan oleh keterbatasan pemahaman pelaku usaha terhadap regulasi dan tingginya biaya pengujian. Sebagai kesimpulan, ada kesenjangan yang signifikan antara peraturan yang ditetapkan dan praktik aktual, yang memerlukan pengawasan pemerintah yang lebih kuat, peningkatan pendidikan konsumen, dan penegakan hukum yang ketat untuk memastikan sistem perlindungan konsumen yang efektif dan adil di sektor air minum isi ulang. Ini akan membantu menciptakan hubungan ekonomi yang seimbang di mana hak-hak konsumen ditegakkan dan bisnis beroperasi secara bertanggung jawab.

| Additional Information: | Concerns about consumer protection in the bottled water industry, particularly in the Rangkasbitung area, are increasing due to widespread violations of quality standards. In fact, consumer protection is a basic right guaranteed by Law No. 8 of 1999. Unfortunately, weak supervision, suboptimal enforcement of regulations, and low awareness among consumers and businesses have allowed these violations to continue. Consumers often do not receive accurate information, safe products, or compensation for losses incurred. On the other hand, business actors tend to ignore their responsibility to guarantee quality and convey information honestly. This study aims to analyze the forms of legal protection for refillable drinking water consumers in Rangkasbitung based on Law No. 8 of 1999, as well as to review the accountability of business actors, particularly at the Alika Refillable Drinking Water Depot, in implementing quality standards. Using a normative empirical juridical approach, the study combines secondary data from regulations, books, and journals, as well as primary data from interviews with legal protection and legal responsibility theories. The results show that legal protection has not been effective. Depots such as Alika are inconsistent in implementing quality standards, including not conducting routine laboratory tests, which results in consumer losses. This lack of accountability is generally caused by business operators' limited understanding of regulations and the high cost of testing. In conclusion, there is a significant gap between established regulations and actual practices, which requires stronger government oversight, improved consumer education, and strict law enforcement to ensure an effective and fair consumer protection system in the refillable drinking water sector. This will help create a balanced economic relationship where consumer rights are upheld and businesses operate responsibly. | |||||||||
