Abstract
Sexual violence against children remains a serious issue in Indonesia, including cases involving children with special needs. Legal protection for victims often does not fully comply with statutory provisions, compounded by limited facilities and support services, resulting in suboptimal justice for the victims. This study aims to analyze the legal protection provided to victims of sexual violence and the effectiveness of the services offered. The research employs a normative juridical method with a descriptive-analytical approach, using secondary data analyzed qualitatively. The theoretical framework includes the theory of legal protection and the theory of victim protection. The findings indicate that legal protection for victims of sexual violence involves both preventive and repressive measures. Preventive efforts include education, socialization of child rights, strengthening family roles, and school involvement in detecting risks of violence. Repressive efforts are implemented through law enforcement, including legal assistance, provision of sign language interpreters, examination processes considering the child’s psychological condition, and imposition of criminal sanctions and restitution for the perpetrators. Service effectiveness is assessed through procedural and service models, with the service model proving more responsive to the physical, psychological, and social needs of victims. The study recommends strengthening service mechanisms and cross-sector coordination to ensure legal protection is comprehensive, responsive, and effective for children with special needs

| Additional Information: | Kekerasan seksual terhadap anak masih menjadi masalah serius di Indonesia, termasuk yang menimpa anak berkebutuhan khusus. Perlindungan hukum bagi korban sering kali belum sesuai ketentuan Undang-Undang, ditambah minimnya fasilitas dan layanan pendukung, sehingga keadilan bagi korban belum terpenuhi secara optimal. Penelitian ini bertujuan menganalisis perlindungan hukum terhadap anak berkebutuhan khusus korban kekerasan seksual serta efektivitas pelayanan yang diberikan. Metode yang digunakan adalah yuridis normatif dengan spesifikasi deskriptif analitis, menggunakan data sekunder yang dianalisis secara kualitatif. Teori yang digunakan mencakup teori perlindungan hukum dan teori perlindungan korban. Hasil penelitian menunjukkan bahwa perlindungan hukum bagi korban kekerasan seksual mencakup upaya preventif dan represif. Upaya preventif dilakukan melalui edukasi, sosialisasi hak anak, penguatan peran keluarga, dan keterlibatan sekolah dalam mendeteksi ABSTRAK risiko kekerasan. Upaya represif diterapkan melalui penegakan hukum, termasuk pendampingan hukum, penyediaan juru bahasa isyarat, dan pemeriksaan yang memperhatikan kondisi psikologis anak, serta pemberian sanksi pidana dan restitusi kepada pelaku. Efektivitas pelayanan dianalisis melalui model prosedural dan model pelayanan, dengan model pelayanan terbukti lebih responsif terhadap kebutuhan fisik, psikologis, dan sosial korban. Penelitian merekomendasikan penguatan mekanisme layanan dan koordinasi lintas sektor agar perlindungan hukum dapat terlaksana secara menyeluruh, responsif, dan efektif bagi anak berkebutuhan khusus. | |||||||||
