Abstract

This research examines the protection of diplomatic representative buildings in armed conflict based on the 1961 Vienna Convention, with a focus on the case study of the attack on the Iranian Embassy Building in Syria, but in its use as a supporting place for diplomatic mission activities between countries that have immunity and cannot be challenged. The receiving state is obliged to take steps to protect and prevent any disturbances both internally and from third countries involved that can disturb the peace of the mission, even if the receiving state is in a state of international or non-international armed conflict, the receiving state is obliged to protect, respect, and maintain the diplomatic representative building. The problem that will be discussed by the researcher is How are the regulations related to the recipient state's responsibilities regarding the privileges of diplomatic representative buildings. The sending state according to the 1961 Vienna Convention and the implementation of the 1961 Vienna Convention regarding the protection of diplomats and Iranian representative buildings. The research method used is normative with a legislative approach and case studies, as well as qualitative descriptive data analysis. The results of this study are as follows: First, the 1961 Vienna Convention requires countries to guarantee the inviolability of the sending state's diplomatic mission building; Both Articles on State Responsibility concern state responsibility for actions that violate international law. Law enforcement relies on evidence and global political decisions, while Israel has not faced significant international sanctions related to the attack on the Iranian Embassy in Syria.

Additional Information: Penelitian ini mengkaji perlindungan terhadap gedung perwakilan diplomatik dalam konflik bersenjata berdasarkan Konvensi Wina 1961, dengan fokus pada studi kasus penyerangan Gedung Kedutaan Besar Iran di Suriah, akan tetapi di dalam penggunaannya sebagai tempat penunjang kegiatan misi diplomatik antar negara yang memiliki kekebalan dan tidak dapat diganggu gugat. Negara penerima wajib mengambil langkah-langkah untuk melindungi serta mencegah setiap gangguan baik secara internal maupun dari negara ketiga yang terlibat yang dapat menggangu perdamaian misi, sekalipun Negara penerima sedang dalam keadaan konflik bersenjata internasional maupun non-internasional, negara penerima wajib melindungi, menghormati, serta memelihara Gedung perwakilan diplomatik. Masalah yang akan dibahas peneliti adalah Bagaimana pengaturan terkait tanggung jawab Negara penerima terhadap hak Istimewa Gedung perwakilan diplomatik. Negara pengirim menurut Konvensi Wina 1961 dan implementasi Konvensi Wina 1961 terkait perlindungan diplomat dan Gedung perwakilan Iran. Metode penelitian yang digunakan adalah normatif dengan pendekatan perundang-undangan dan studi kasus, serta analisis data deskriptif kualitatif. Adapun hasil penelitian ini sebagai berikut: Pertama Konvensi Wina 1961 mewajibkan Negara-negara menjamin tidak diganggu gugatnya terhadap Gedung misi diplomatik Negara pengirim; Kedua Articles on State Responsibility mengenai tanggung jawab negara atas tindakan yang melanggar hukum internasional. Penegakan hukum bergantung pada bukti dan keputusan politik global, sementara Israel belum menghadapi sanksi internasional yang signifikan terkait dengan kasus penyerangan Kedutaan Iran di Suriah.
