Abstract

This study discusses the use of cyber operations in the Russian-Ukrainian war, in which Russia used cyber operations as a method of warfare in conducting its military operations. However, the use of cyber operations did not target the intended targets but instead affected civilians. Therefore, this study discusses how cyber operations are regulated in international humanitarian law and the Tallinn Manual 2.0 on The International Law Applicable to Cyber Operations and whether the use of cyber operations by Russia in the Russian-Ukrainian war is in accordance with international humanitarian law. This study uses legal certainty theory and humanitarian principles to assist in the research. The research method used is normative legal research with descriptive analysis based on international conventions. The results of the study show that the regulation of cyber operations is contained in the Hague Convention IV of 1907, the Geneva Convention IV of 1949, Additional Protocol I of 1907 and Rules 94, Rule 105, Rule 110, Rule 113 of the Tallinn Manual 2.0 on The International Law Applicable to Cyber Operations. It was then found that Russia's use of cyber operations against Ukraine had an impact on civilians and did not follow the rules and principles of international humanitarian law, resulting in the illegality of Russia's use of cyber operations in the war between Russia and Ukraine.

Additional Information: Penelitian ini membahas mengenai penggunaan operasi siber dalam perang Rusia dan Ukraina, dalam perang tersebut penggunaan operasi siber digunakan oleh pihak Rusia sebagai salah satu metode perang dalam menjalankan operasi militernya, akan tetapi penggunaan operasi siber tersebut tidaklah mengenai sasaran yang seharusnya melainkan berdampak terhadap penduduk sipil, oleh sebab itu penelitian ini membahas mengenai bagaimana pengaturan operasi siber dalam hukum humaniter internasional dan Tallinn Manual 2.0 on The International Law Applicable to Cyber Operations dan apakah penggunaan operasi siber yang digunakan oleh Rusia di perang Rusia dan Ukraina telah sesuai dengan hukum humaniter internasional. Penelitian ini menggunakan teori kepastian hukum dan priinsip kemanusiaan untuk membantu dalam penelitian. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan deskriptif analitis berdasarkan konvensi internasional. Hasil penelitian menjunjukkan bahwa pengaturan operasi siber terdapat dalam Konvensi Den Haag IV 1907, Konvensi Jenewa IV 1949, Protokol Tambahan I 1907 dan Rule 94, Rule 105, Rule 110, Rule 113 Tallinn Manual 2.0 on The International Law Applicable to Cyber Operations, kemudian ditemukan bahwa penggunaan operasi siber oleh Rusia ke Ukraina berdampak terhadap penduduk sipil dan tidak mengikuti aturan-aturan serta prinsip-prinsip dalam hukum humaniter internasional yang mengakibatkan tidak sahnya penggunaan operasi siber oleh Rusia dalam perang Rusia dan Ukraina.
