Abstract
This research examines the legal liability of PT Satria Motor Indonesia for breach of contract in the delivery agreement of electric vehicles to consumers. The background of this study arises from the fact that certain business actors fail to fulfill their contractual obligations, resulting in the violation of consumer rights. The issues discussed in this research include the forms of breach of contract that occurred and the legal consequences imposed on the company as the defaulting party in fulfilling its contractual obligations. This study employs a normative juridical method with statutory, conceptual, and case approaches, utilizing secondary data consisting of legislation, legal literature, academic journals, and court decisions. The findings indicate that PT Satria Motor Indonesia repeatedly committed breaches of contract, including failing to deliver the electric vehicles within the agreed timeframe and neglecting its refund obligations to consumers. Such breaches provide a legal basis for consumers to enforce their rights through both litigation and non-litigation mechanisms. The legal consequences of the breach emphasize the importance of compliance with contractual obligations as well as the implementation of the principles of pacta sunt servanda and good faith in commercial transactions. Consumers suffering losses are entitled to file civil lawsuits or seek alternative dispute resolution through conciliation, mediation, or arbitration. Moreover, consumer protection institutions play a strategic role in ensuring legal protection and legal certainty for consumers.

| Additional Information: | Penelitian ini membahas tanggung jawab hukum PT Satria Motor Indonesia terhadap wanprestasi dalam perjanjian pengiriman mobil listrik kepada konsumen. Latar belakang penelitian ini berangkat dari kenyataan bahwa masih terdapat pelaku usaha yang tidak memenuhi kewajiban kontraktualnya sehingga mengakibatkan hak-hak konsumen terabaikan. Permasalahan yang dikaji mencakup bentuk wanprestasi yang terjadi serta akibat hukum yang timbul bagi perusahaan sebagai pihak yang lalai dalam memenuhi kewajiban perjanjian. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan kasus, serta memanfaatkan data sekunder berupa peraturan perundang-undangan, literatur hukum, jurnal ilmiah, dan putusan pengadilan. Hasil penelitian menunjukkan bahwa PT Satria Motor Indonesia telah melakukan wanprestasi secara berulang, antara lain dengan tidak menyerahkan kendaraan listrik sesuai waktu yang diperjanjikan serta tidak melaksanakan kewajiban refund kepada konsumen. Tindakan wanprestasi tersebut memberikan dasar hukum bagi konsumen untuk menuntut haknya melalui mekanisme litigasi maupun non-litigasi. Akibat hukum dari wanprestasi tersebut menegaskan pentingnya kepatuhan terhadap perjanjian serta pelaksanaan asas pacta sunt servanda dan itikad baik dalam transaksi bisnis. Konsumen yang mengalami kerugian memiliki hak untuk mengajukan gugatan perdata maupun menempuh penyelesaian sengketa melalui konsiliasi, mediasi, dan arbitrase. Selain itu, lembaga perlindungan konsumen memiliki peran strategis dalam memberikan perlindungan hukum dan menjamin kepastian hukum bagi konsumen. | ||||||||||||
