Abstract
This study discusses the use of civilian AWS drones in the armed conflict between Russia and Ukraine. In this conflict, the use of civilian drones modified into AWS was chosen by both sides as a substitute for military drones. The use of civilian drones became an alternative because they were cheaper, easier access, and greater effectiveness compared to military drones. However, the use of civilian AWS drones has resulted in civilian casualties. Therefore, this study discusses the regulations governing AWS and the consequences of using civilian drones modified into AWS. This study uses the Just War Theory and the Principles of Humanity to assist in the research. The research method used is normative legal research with a descriptive qualitative approach based on international treaty regulations. The results of the study reveal that there are no specific regulations that directly govern AWS, but there are other written regulations that govern methods of warfare that can be linked to AWS drones, and there are also regulations that are similar to AWS drones in terms of their mechanisms. then there are implications given by civilian AWS drones, namely misuse, accountability challenges, and humanitarian assistance. It is hoped that there will be regulations governing AWS drones and a legal body to oversee the use of civilian AWS drones.

| Additional Information: | Penelitian ini membahas mengenai penggunaan AWS drone sipil dalam konflik bersenjata antara Rusia dan Ukraina, dalam konflik tersebut penggunaan drone sipil yang dimodifikasi menjadi AWS yang dijadikan pilihan bagi kedua pihak sebagai pengganti drone militer, penggunaan drone sipil ini menjadi alternatif karena biaya yang lebih murah, lebih mudah diakses, dan juga lebih efektif dibandingkan drone militer, tetapi penggunaan drone sipil AWS ini mengakibatkan pada korban warga sipil, oleh sebab itu penelitian ini membahas mengenai apa saja peraturan-peraturan yang mengikat AWS tersebut dan juga mengenai apa akibat-akibat penggunaan drone sipil yang dimodifikasi menjadi AWS. Penelitian ini menggunakan teori perang adil (Just War Theory), dan juga menggunakan Prinsip Kemanusiaan untuk membantu dalam penelitian. Metode penelitian yang digunakan penelitian hukum normatif dengan pendekatan deskriptif kuaitatif berdasarkan peraturan perjanjian internasional. Hasil penelitian mengungkapkan bahwasannya pengaturan AWS secara langsung yang khusus mengatur AWS belum ada, tetapi ada peraturan tertulis lain yang mengatur metode perang yang bisa dikaitkan dengan drone AWS dan ada juga pengaturan yang mirip seperti drone AWS secara mekanismenya, lalu ada implikasi-implikasi yang diberikan oleh drone sipil AWS yaitu penyalahgunaan, tantangan akuntabilitas, dan bantuan kemanusiaan. Diharapkan ada peraturan yang mengatur mengenai drone AWS dan ada badan hukum yang mengawasi penggunaan drone sipil AWS. | |||||||||
