Abstract
An entrepreneur is the party that runs a business or company and employs workers/laborers with the goal of making a profit. Employers have a responsibility to fulfilll the rights of their workers. One of the rights of workers is to receive overtime pay. In Article 78 paragraph (2) of the Labor Law, employers who employ their workers beyond working hours are obliged to pay overtime wages. However, in practice, there are still entrepreneurs who disregard these regulations. One of them is the company Ray White Fatmawati Boulevard; the workers there are not receiving their rights to overtime pay, which is against the applicable regulations. Based on the background of the problem, it can be identified as follows: 1. What is the employer's responsibility for workers' overtime wage rights based on Article 78 paragraph (2) of Law Number 13 of 2003 concerning Manpower; 2. What is the legal certainty regarding overtime wages received by workers at the Ray White Fatmawati Boulevard company. The theories used in this research are the theory of legal responsibility and the theory of legal certainty. The method used in this research is normative-empirical legal, employing a legislative approach, a case approach, and a conceptual approach. The data obtained uses secondary data and primary data as supporting information. The research results indicate that Ray White Fatmawati Boulevard's responsibility as an employer for paying overtime wages to its workers has not yet been fulfilled. And the workers also did not receive legal certainty regarding the overtime wages. Therefore, Ray White Fatmawati Boulevard should be responsible for paying the workers' overtime wages, so that the workers have certainty about their overtime pay.

| Additional Information: | Pengusaha merupakan pihak yang menjalankan suatu usaha atau perusahaan dan mempekerjakan pekerja/buruh dengan tujuan memperoleh keuntungan. Pengusaha memiliki tanggung jawab dalam memenuhi hak-hak para pekerjanya. Salah satu hak pekerja yaitu, menerima upah kerja lembur. Dalam Pasal 78 ayat (2) Undang-Undang Ketenagakerjaan, pengusaha yang mempekerjakan pekerjanya melebihi waktu kerja, wajib membayar upah kerja lembur. Namun, dalam praktiknya masih terdapat pengusaha yang tidak mengindahkan peraturan tersebut. Salah satunya adalah perusahaan Ray White Fatmawati Boulevard, para pekerja di sana tidak mendapatkan haknya atas upah kerja lembur, yang di mana hal tersebut bertentangan dengan peraturan yang berlaku. Berdasarkan latar belakang masalah tersebut dapat diidentifikasi sebagai berikut: 1. Bagaimana tanggung jawab pengusaha atas hak upah kerja lembur pekerja berdasarkan Pasal 78 ayat (2) Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan; 2. Bagaimana kepastian hukum atas upah kerja lembur yang diterima oleh pekerja di perusahaan Ray White Fatmawati Boulevard. Teori yang digunakan dalam penelitian ini adalah teori tanggung jawab hukum dan teori kepastian hukum. Metode yang digunakan dalam penelitian ini adalah yuridis normatif-empiris, melalui pendekatan perundang-undangan, pendekatan kasus, dan pendekatan konseptual. Data yang diperoleh menggunakan data sekunder dan data primer sebagai pendukung. Hasil penelitian menunjukan bahwa tanggung jawab Ray White Fatmawati Boulevard selaku pengusaha atas pembayaran upah kerja lembur terhadap pekerja, masih belum terpenuhi. Dan para pekerja pun tidak mendapatkan kepastian hukum atas upah kerja lembur tersebut. Oleh karena itu, seharusnya Ray White Fatmawati Boulevard bertanggung jawab atas pembayaran hak upah kerja lembur pekerja, sehingga pekerja mendapatkan kepastian atas upah kerja lemburnya. | |||||||||
