Abstract

The shipyard industry is one of the vital sectors in the global economy that contributes significantly to economic growth and creates jobs. However, behind this progress, this industry also faces serious challenges related to occupational safety, given the high risk of work accidents that can occur. Therefore, the regulations stipulated in Law Number 13 of 2003 concerning Manpower and Law Number 1 of 1970 concerning Occupational Safety serve as the legal basis for companies in creating a safe and healthy work environment. Identification of emerging problems in this case analyzes the implementation of K3 at PT. Samudra Marine Indonesia and identifies the legal consequences that arise after a work accident based on both laws. The method used is a empirice juridical approach with qualitative analysis. Data sources are divided into primary data obtained from the results of field interviews with K3 Management of PT. Samudra Marine Indonesia and Officials of the Serang Regency Manpower UPTD and secondary data which are official documents, books and several research results in the form of reports obtained from the Sultan Ageng Tirtayasa University Library and as well as several quotes from the internet The results of the study indicate that the implementation of occupational safety at PT. Samudra Marine Indonesia adheres to laws and regulations, including OHS training, internal audits, reporting systems, and disciplinary action against violations. However, weaknesses remain, such as the lack of independent external audits and low awareness of safety procedures among some workers. Legally, workplace accidents create legal liability for the company, including the obligation to provide compensation to victims and potential administrative and even criminal sanctions for negligent parties. The implementation of occupational safety at PT. Samudra Marine Indonesia is not fully compliant with applicable regulations, given the continued occurrence of workplace accidents and the absence of external audits. Low worker compliance with OHS is a major cause of accidents. The legal consequences of workplace accidents reflect the importance of repressive legal protection for workers through compensation and sanctions for those responsible.

Additional Information: Industri galangan kapal merupakan salah satu sektor vital dalam perekonomian global yang memberikan kontribusi signifikan terhadap pertumbuhan ekonomi serta menciptakan lapangan kerja. Namun, di balik kemajuan tersebut, industri ini juga menghadapi tantangan serius terkait keselamatan kerja, mengingat tingginya risiko kecelakaan kerja yang dapat terjadi. Oleh karena itu, regulasi yang tertuang dalam Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan dan Undang-Undang Nomor 1 Tahun 1970 tentang Keselamatan Kerja menjadi landasan hukum bagi perusahaan dalam menciptakan lingkungan kerja yang aman dan sehat. Identifikasi masalah yang muncul dalam hal ini menganalisis penerapan K3 di PT. Samudra Marine Indonesia serta mengidentifikasi akibat hukum yang timbul setelah terjadinya kecelakaan kerja berdasarkan kedua undang-undang tersebut. Metode yang digunakan adalah pendekatan yuridis empiris dengan analisis kualitatif. Sumber data terbagi menjadi data primer yang didapat dari hasil wawancara di lapangan kepada Manajemen K3 PT. Samudra Marine Indonesia dan Pejabat UPTD Ketenagakerjaan Kabupaten Serang dan data sekunder yang merupakan dokmen dokumen resmi, buku buku dan beberapa hasil penelitian yang berwujud laporan yang didapat dari Perpustakaan Universitas Sultan Ageng Tirtayasa dan serta beberapa kutipan dari internet Hasil penelitian menunjukkan bahwa penerapan keselamatan kerja di PT. Samudra Marine Indonesia sudah berpedoman pada peraturan perundang undangan, dengan adanya pelatihan K3, audit internal, sistem pelaporan, dan penegakan disiplin terhadap pelanggaran. Namun demikian, masih terdapat kelemahan, seperti belum adanya audit eksternal independen serta rendahnya kesadaran sebagian pekerja terhadap prosedur keselamatan. Dari sisi hukum, kecelakaan kerja menimbulkan tanggung jawab hukum bagi perusahaan berupa kewajiban pemberian kompensasi kepada korban serta kemungkinan sanksi administratif hingga pidana bagi pihak yang lalai. Penerapan keselamatan kerja di PT. Samudra Marine Indonesia belum sepenuhnya sesuai dengan peraturan yang berlaku, mengingat masih adanya kecelakaan kerja dan ketiadaan audit eksternal. Rendahnya kepatuhan pekerja terhadap K3 menjadi penyebab utama kecelakaan. Akibat hukum dari kecelakaan kerja mencerminkan pentingnya perlindungan hukum represif bagi pekerja melalui kompensasi dan sanksi bagi pihak yang bertanggung jawab.
