Abstract
The 1961 Apostille Convention provides convenience by streamlining the process of legalizing documents in Indonesia for use abroad. Indonesia has acceded to the convention through Presidential Regulation No. 2 of 2021 concerning the ratification of the convention abolishing the requirement of legalization for foreign public documents, appointing the Ministry of Law of the Republic of Indonesia as the competent authority. However, the implementation of apostille in Indonesia still faces several problems, including low public awareness, limited digital systems, and suboptimal coordination between institutions. The method used is normative juridical, which uses legislation and secondary data sources by apostille applicants. This apostille convention has a positive impact on the investment climate through an increase in The Ease Of Doing Business (EODB) ranking and facilitates the circulation of documents between participating countries. However, the implementation of apostille in Indonesia still has shortcomings, because it only formally certifies public documents and does not substantially legalize them. Possible solutions include decentralizing the apostille so that each regional office of the Ministry of Law can process apostille applications. This must be accompanied by increased socialization, digital infrastructure, and periodic evaluations for the benefit of the Indonesian people.

| Additional Information: | Konvensi Apostille 1961 memberikan kemudahan melalui pemangkasan proses legalisasi dokumen yang diterbitkan oleh Indonesia untuk digunakan di luar negeri. konvensi tersebut telah diaksesi oleh Indonesia melalui Peraturan Presiden Nomor 2 Tahun 2021 Tentang Pengesahan Convention Abolishing The Requirement Of Legalisation For Foreign Public Documents, dengan menunjuk Kementrian Hukum Republik Indonesia sebagai competent authority-nya. meskipun demikian, penerapan Apostille di Indonesia masih memiliki beberapa permasalahan meliputi rendahnya pemahaman masyarakat, keterbatasan sistem digital, serta koordinasi antar lembaga yang belum optimal. metode yang digunakan adalah yuridis normatif yang menggunakan Peraturan Perundangundangan dan sumber data sekunder berupa wawancara oleh Pemohon Apostille. Konvensi Apostille ini berdampak baik pada iklim investasi melalui peningkatan peringkat Ease Of Doing Business (EODB) serta memudahkan sirkulasi masuk dan keluarnya dokumen antar negara peserta konvensi. namun begitu, penerapan Apostille di Indonesia pun masih memiliki kekurangan, karena hanya secara formil mengesahkan dokumen publik dan tidak secara substansial dalam proses pelegalisasian dokumen tersebut. Solusi yang dapat ditawarkan mencakup desentralisasi apostille agar setiap kantor wilayah kementerian hukum daerah dapat melayani permohonan apostille juga harus dibersamai dengan peningkatan sosialisasi, infrastruktur digital, serta evaluasi berkala demi kebermanfaatan untuk masyarakat Indonesia. | |||||||||
