Abstract
The rapid development of Artificial Intelligence (AI) technology has brought various conveniences as well as challenges to people's lives. One of the main challenges that has emerged is the misuse of Artificial Intelligence (AI) technology in the form of deepfake porn crimes, namely the creation and distribution of fake pornographic content that utilizes image and sound manipulation technology. This phenomenon raises legal problems related to the criminal liability of the perpetrators, considering that there are no regulations that specifically regulate these crimes in the national criminal law system. This study aims to analyze the concept and application of criminal liability for perpetrators of misuse of Artificial Intelligence (AI) technology in deepfake porn crimes and to examine the urgency of reforming criminal law to accommodate the dynamics of digital technology. The research method used is normative juridical with a library research approach, which includes analysis of relevant laws, literature, and judges' decisions. The results of the study indicate that there is a legal vacuum in the regulation of the misuse of Artificial Intelligence (AI) technology in deepfake porn crimes, so that the criminal liability of the perpetrators is not optimal and complicates the law enforcement process. Therefore, criminal law reform through revision of laws and development of complementary regulations is needed to provide legal certainty, protection for victims, and a deterrent effect for perpetrators. This study recommends the implementation of specific legal regulations governing the misuse of Artificial Intelligence (AI) technology in the context of sexual crimes, including deepfake porn, in order to comprehensively address legal challenges in the digital era.

| Additional Information: | Pesatnya perkembangan teknologi Artificial Intelligence (AI) telah menghadirkan berbagai kemudahan sekaligus tantangan dalam kehidupan masyarakat. Salah satu tantangan utama yang muncul adalah penyalahgunaan teknologi AI dalam bentuk kejahatan deepfake porn, yakni pembuatan dan penyebaran konten pornografi palsu yang memanfaatkan teknologi manipulasi gambar dan suara. Fenomena ini menimbulkan permasalahan hukum terkait pertanggungjawaban pidana pelaku, mengingat belum adanya regulasi yang secara khusus mengatur kejahatan tersebut dalam sistem hukum pidana nasional. Penelitian ini bertujuan untuk menganalisis konsep dan penerapan pertanggungjawaban pidana terhadap pelaku penyalahgunaan teknologi AI pada kejahatan deepfake porn serta mengkaji urgensi pembaharuan hukum pidana guna mengakomodasi dinamika teknologi digital. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan studi kepustakaan (library research), yang mencakup analisis terhadap peraturan perundang-undangan, literatur, dan putusan hakim yang relevan. Hasil penelitian menunjukkan bahwa terdapat kekosongan hukum dalam pengaturan penyalahgunaan teknologi AI pada kejahatan deepfake porn, sehingga pertanggungjawaban pidana pelaku menjadi tidak optimal dan menyulitkan proses penegakan hukum. Oleh karena itu, pembaharuan hukum pidana melalui revisi undang-undang serta pengembangan regulasi pelengkap diperlukan untuk memberikan kepastian hukum, perlindungan terhadap korban, dan efek jera bagi pelaku. Penelitian ini merekomendasikan penerapan peraturan hukum yang spesifik yang mengatur penyalahgunaan teknologi AI dalam konteks kejahatan seksual, termasuk deepfake porn, guna mengatasi tantangan hukum di era digital secara komprehensif. | |||||||||
