Abstract

The rapid development of information and communication technology has transformed consumer behavior, particularly in online transactions conducted through social media platforms such as Instagram. Although e-commerce offers convenience and accessibility, it also creates new legal challenges, especially concerning the circulation of counterfeit branded goods that harm consumers. This study aims to examine the legal protection for consumers who suffer losses from purchasing counterfeit goods through Instagram-based e-commerce, with a focus on consumer legal remedies and the responsibilities of business actors under Law Number 8 of 1999 on Consumer Protection. The research employs an empirical juridical method, combining primary and secondary data obtained through interviews and literature studies. Interviews were conducted with affected consumers, business actors, representatives from the Directorate General of Intellectual Property (DGIP), law enforcement authorities, and consumer protection institutions. The study applies statutory and conceptual approaches, with the Consumer Protection Law as the primary legal reference. Theoretical frameworks employed include the Theory of Legal Protection and the Theory of Legal Responsibility.The case under review involves an Instagram influencer, identified as DS, who sold counterfeit Yves Saint Laurent (YSL) bags while claiming authenticity supported by certificates. The business actor violated Articles 4, 7, 8, and 9 of the Consumer Protection Law by providing misleading information, selling counterfeit goods as originals, and refusing to provide compensation. Furthermore, the business actor neglected legal responsibilities as stipulated in Articles 19 and 23 of the same law. From a criminal law perspective, these actions fulfill the elements under Article 62 of the Consumer Protection Law and Article 45A paragraph (1) of Law Number 11 of 2008 on Electronic Information and Transactions. This study highlights the importance of legal protection in digital transactions and emphasizes the need for government oversight and legal education for consumers in the digital era.

Additional Information: Perkembangan teknologi informasi dan komunikasi yang pesat telah mengubah perilaku konsumen, khususnya dalam transaksi daring melalui platform media sosial seperti instagram. Meskipun e-commerce menawarkan kemudahan dan aksesibilitas, hal ini juga menimbulkan tantangan hukum baru, terutama terkait peredaran barang bermerek palsu yang merugikan konsumen. Penelitian ini bertujuan untuk mengkaji perlindungan hukum bagi konsumen yang mengalami kerugian akibat pembelian barang palsu melalui e-commerce berbasis Instagram, dengan menyoroti upaya hukum konsumen dan tanggung jawab pelaku usaha berdasarkan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Metode yang digunakan adalah yuridis empiris, dengan menggabungkan data primer dan data sekunder dari wawancara serta studi pustaka. Wawancara dilakukan dengan konsumen yang dirugikan, pelaku usaha, perwakilan Direktorat Jenderal Kekayaan Intelektual (DJKI), aparat penegak hukum, dan lembaga perlindungan konsumen. Pendekatan yang digunakan mencakup pendekatan perundang-undangan dan konseptual, dengan acuan utama Undang-Undang Perlindungan Konsumen. Teori yang digunakan dalam analisis penelitian ini adalah Teori Perlindungan Hukum Dan teori tanggung Jawab Hukum. Kasus yang dikaji melibatkan seorang influencer Instagram berinisial DS yang menjual tas Yves Saint Laurent (YSL) palsu dengan klaim keaslian disertai sertifikat. Pelaku usaha melanggar ketentuan Pasal 4, Pasal 7, Pasal 8, dan Pasal 9 Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen dengan memberikan informasi menyesatkan, menjual barang tiruan sebagai barang asli, dan menolak memberikan ganti rugi. Selain itu, pelaku usaha juga mengingkari tanggung jawab hukum sebagaimana diatur dalam Pasal 19 dan Pasal 23 Undang-Undang Perlindungan Konsumen. Secara pidana, tindakan tersebut memenuhi unsur dalam Pasal 62 Undang-Undang Perlindungan Konsumen serta Pasal 45A ayat (1) Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik. Studi ini menekankan pentingnya perlindungan hukum dalam transaksi digital serta perlunya pengawasan pemerintah dan edukasi hukum bagi konsumen di era digital.
