Abstract
Workers often face various risks that can threaten their welfare while carrying out their duties, such as work accidents, job loss, and uncertainty about the future after the end of their employment period. Therefore, legal protection measures are needed in the form of employment social security as regulated in Article 15 of the BPJS Law, which states that employers are obliged to register their workers for employment social security in stages. This study aims to analyze the legal protection of the rights of coffee shop workers who have not registered their workers for employment social security and the legal consequences of employers who do not register their workers for employment social security with a case study of coffee shops in Menteng Village and Jl. Pajajaran, Bogor City. The theories used in this study are the theory of legal protection and the theory of legal responsibility. This study uses the Normative-Empirical Juridical method, with a legislative approach, a case approach, and a conceptual approach as well as interviews with related parties. Data sources consist of primary data and secondary data obtained from field studies and literature studies. Data analysis used descriptive analysis with a qualitative approach. The results of the study indicate that legal protection related to employment social security in the provisions of Article 15 of the BPJS Law has not been implemented by the employers who are the samples in this study. Failure to register workers for employment social security will result in legal consequences as regulated in Article 17 of Law No. 11 of 2011 concerning BPJS, namely administrative sanctions in the form of not receiving certain public services. However, there has been no follow-up from the BPJS Employment because there has been no report from the coffee shop workers, so that supervision of the BPJS Law and PP regarding the imposition of administrative sanctions by BPJS Employment is needed to ensure comprehensive legal protection for coffee shop workers

Oleh karena itu, diperlukan langkah-langkah perlindungan hukum berupa jaminan sosial ketenagakerjaan sebagaimana diatur dalam Pasal 15 UU BPJS, yang menyatakan pemberi kerja wajib untuk mendaftarkan pekerjanya pada jaminan sosial ketenagakerjaan secara bertahap. Penelitian ini bertujuan untuk menganalisis perlindungan hukum terhadap hak pekerja coffee shop yang belum mendaftarkan pekerjanya ke dalam jaminan sosial ketenagakerjaan serta akibat hukum dari pengusaha yang tidak mendaftarkan pekerjanya dalam jaminan sosial ketenagakerjaan dengan studi kasus coffee shop Kelurahan Menteng dan Jl. Pajajaran Kota Bogor. Teori yang digunakan dalam penelitian ini yaitu teori perlindungan hukum dan teori tanggung jawab hukum. Penelitian ini menggunakan metode Yuridis Normatif-Empiris, dengan pendekatan perundangundangan, pendekatan kasus, dan pendekatan konseptual serta wawancara terhadap pihak terkait. Sumber data terdiri dari data primer dan data sekunder yang diperoleh dari studi lapangan dan studi kepustakaan. Analisis data yang digunakan deskriptif analitis dengan pendekatan kualitatif. Hasil penelitian menunjukkan bahwa perlindungan hukum terkait jaminan sosial ketenagakerjaan dalam ketentuan Pasal 15 UU BPJS belum dilaksanakan oleh pemberi kerja yang menjadi sampel dalam penelitian ini. Tidak didaftarkannya pekerja pada jaminan sosial ketenagakerjaan akan menimbulkan akibat hukum sebagaimana yang telah diatur dalam Pasa 17 UU No. 11 Tahun 2011 tentang BPJS, yaitu sanksi administrasi berupa tidak mendapatkan pelayanan publik tertentu. Akan tetapi belum ada tindak lanjut dari pihak BPJS Ketenagakerjaan karena belum ada pelaporan dari pekerja coffee shop tersebut, sehingga diperlukan pengawasan terhadap UU BPJS dan PP terkait pemberian sanksi administratif BPJS Ketenagakerjaan guna menjamin perlindungan hukum secara menyeluruh bagi pekerja coffee shop. | |||||||||
