Abstract
Solo iced tea is one of the drinks that is popular with the public because of itsfresh taste and af ordable price. This drink is a favorite choice especially duringhot weather. However, as business competition increases, one of the businessactors commits fraud in his sales by mixing expired tea with fresh tea. Sellingexpired iced tea can of course be detrimental to consumers. The identificationof the problem in this study is how legal protection for consumers regarding the saleof expired Solo iced tea drinks is reviewed based on Law Number 8 of 1999concerning Consumer Protection in conjunction with Law Number 18 of 2012concerning Food, and what the responsibility of business actors for lossesexperienced by consumers due to the sale of expired Solo iced tea drinks. Thetheories used are the theory of legal protection and the theory of legal responsibility. The method used is the normative legal method. The typeof research used is qualitative research with a legislative approach, a conceptual approach, and a case approach. The data sources used are primary dataandsecondary legal data. The results of this study show that the sale of expiredSoloiced tea drinks has violated Articles 4, 7, 8 and 9 of Law Number 8 of 1999concerning Consumer Protection and Articles 68, 89 and 90 of Law Number 18of 2012 concerning Food. Consumer legal ef orts regarding the sale of expiredSoloiced tea drinks that can be carried out if consumers feel disadvantaged due totheactions of irresponsible business actors can make a complaint report to the Foodand Drug Supervisory Agency or to related institutions. The responsibilityof business actors to consumers with good faith apologies, providing compensation, damages and/or replacement of products that do not match what was promised. Ef orts to resolve disputes that can be done through the courts or outside thecourts. Consumers must be smarter and more careful in choosing products andconsumers must also dare to demand their rights if they are harmed.

| Additional Information: | Es teh tubruk solo merupakan salah satu minuman yang digemari masyarakat karena rasanya yang segar serta harganya yang terjangkau. Minuman ini menjadi pilihan favorit terutama saat cuaca panas. Namun, seiring meningkatnyapersaingan usaha membuat salah satu pelaku usaha melakukan tindakankecurangan dalam jualan nya dengan mencampur teh yang telah kadaluwarsadengan teh yang masih baru. Dengan menjual es teh yang sudah kadaluwarsatentu saja dapat merugikan pihak konsumen. Adapun identifikasi masalah dalampenelitian ini yaitu, bagaimana perlindungan hukum terhadap konsumenataspenjualan minuman es teh tubruk solo kadaluwarsa ditinjau berdasarkan Undang- Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen Juncto Undang- Undang Nomor 18 Tahun 2012 tentang Pangan, dan bagaimana tanggungjawabpelaku usaha atas kerugian yang dialami konsumen akibat penjualan minumanesteh solo kadaluwarsa. Teori yang digunakan adalah teori perlindungan hukumdanteori tanggungjawab hukum. Metode yang digunakan adalah metode yuridisnormatif. Jenis penelitian yang digunakan adalah penelitian kualitatif denganpendekataan perundang-undangan, pendekatan konseptual, dan pendekatan kasus. Sumber data yang digunakan adalah data primer dan data hukumsekunder. Hasil dari penelitian ini, bahwasanya penjualan minuman es teh tubruk solokadaluwarsa telah melanggar Pasal 4, 7, 8 dan 9 Undang-Undang Nomor 8 Tahun1999 tentang Perlindungan Konsumen serta Pasal 68, 89 dan 90 Undang-UndangNomor 18 Tahun 2012 tentang Pangan. Upaya hukum konsumen atas penjualanminuman es teh tubruk solo kadaluwarsa yang dapat dilakukan apabila konsumenmerasa dirugikan akibat tindakan pelaku usaha yang tidak bertanggung jawabdapat membuat laporan pengaduan kepada Badan Pengawas Obat dan Makananatau kepada lembaga-lembaga terkait. Tanggung jawab pelaku usaha terhadapkonsumen dengan adanya itikad baik permintaan maaf, memberikan kompensasi, ganti rugi dan/atau penggantian produk yang tidak sesuai dengan yang dijanjikan. Upaya penyelesaian sengketa yang dapat dilakukan melalui pengadilan ataupunluar pengadilan. Konsumen harus lebih cerdas dan berhati-hati dalammemilihproduk dan konsumen juga harus berani dalam menuntut haknya apabiladirugikan. | |||||||||
