Abstract
The construction services sector is a crucial part of national development as it plays a key role in creating infrastructure that supports social and economic activities. Many construction projects that do not comply with the contract result in incomplete construction procurement agreements, resulting in losses for both service users and providers. The discrepancy in the final results due to the lack of quality asphalt density in the Pakupatan-Palima road widening construction project resulted in incomplete construction agreements. Asphalt density that is insufficient or does not meet the standard qualifications set by SNI can affect the durability of the road surface, reduce resistance to traffic loads, and accelerate damage to the road structure. The problem in this discussion is how to implement cooperation contracts for road widening construction and the form of service provider accountability for non-compliance with the contract, particularly regarding the results of construction quality testing. The research method used in this study is an empirical juridical method with a descriptive analytical approach. Data were obtained through observation, interviews, and document studies in the field, then analyzed qualitatively. The results of the study indicate that the work has been carried out in accordance with the timeframe and material provisions stated in the established contract and the work was delivered on time. However, the final results in the final testing phase of this road widening construction work did not reach 98% in accordance with the applicable technical provisions. This states that the provider has not met the work quality requirements as stipulated in Article 17 paragraph (2) of Presidential Regulation No. 12 of 2021 concerning Government Procurement of Goods/Services. The responsibility of CV. Bayanaka Putra based on the provisions in the contract states that any discrepancy between the work results and the agreed technical specifications is the responsibility of the provider. In this case, the provider is responsible by making budget cuts as compensation for the lack of work quality.

| Additional Information: | Sektor jasa konstruksi merupakan bagian penting dalam pembangunan nasional karena berperan dalam mewujudkan infrastruktur yang mendukung aktivitas sosial dan ekonomi masyarakat. Banyaknya pelaksanaan pembangunan yang tidak sesuai dengan kontrak menyebabkan perjanjian pengadaan konstruksi tidak terlaksana secara sempurna dan menimbulkan kerugian bagi pihak pengguna jasa maupun penyedia. Adanya ketidaksesuaian hasil akhir karena kurangnya mutu pada density aspal dalam proyek konstruksi pelebaran jalan Pakupatan-Palima menyebabkan perjanjian konstruksi tidak terlaksana secara sempurna. Density aspal yang kurang atau tidak sesuai dengan kualifikasi standar yang ditetapkan oleh SNI dapat mempengaruhi daya tahan permukaan jalan, mengurangi ketahanan terhadap beban lalu lintas, serta mempercepat kerusakan pada struktur jalan. Adapun permasalahan dalam pembahasan ini adalah bagaimana pelaksanaan perjanjian kontrak kerja sama pada konstruksi pelebaran jalan serta bentuk pertanggungjawaban penyedia jasa atas ketidaksesuaian dengan kontrak, khususnya terkait hasil pengujian mutu konstruksi. Metode penelitian yang digunakan dalam penelitian ini adalah metode yuridis empiris dengan pendekatan deskriptif analitis. Data diperoleh melalui observasi, wawancara, dan studi dokumen di lapangan, kemudian dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa pekerjaan telah dilaksanakan sesuai dengan jangka waktu dan ketentuan material yang tertera dalam kontrak yang telah ditetapkan dan menyerahkan pekerjaannya tepat waktu. Namun, hasil akhir dalam tahap pengujian akhir pada pekerjaan pembangunan pelebaran jalan ini tidak mencapai 98% sesuai dengan ketentuan teknis yang berlaku. Hal ini menyatakan bahwa penyedia belum memenuhi persyaratan mutu pekerjaan sebagaimana diatur dalam Pasal 17 ayat (2) Peraturan Presiden No. 12 Tahun 2021 tentang Pengadaan Barang/Jasa Pemerintah. Tanggung jawab CV. Bayanaka Putra berdasarkan ketentuan dalam kontrak menyatakan bahwa setiap ketidaksesuaian hasil pekerjaan dengan spesifikasi teknis yang telah disepakati menjadi tanggung jawab penyedia. Dalam hal ini penyedia bertanggung jawab dengan cara melakukan pemotongan anggaran sebagai kompensasi atas kurangnya mutu pekerjaan. | |||||||||
