Abstract
The change in the allocation of madrasah waqf land to residential houses without permission from the Minister of Religion and approval from the Indonesian Waqf Board. This will cause problems in the future because there is no legal certainty. This study aims to analyze changes in the allocation of waqf land in Kepandean Village, as well as examine the legal consequences. The theories used in this study are maslahah theory and legal certainty theory. The method used in this study is the empirical juridical method, which is a method that is carried out directly in the field using direct interviews from related parties, then it will be linked to current laws and regulations and legal theories. The results of this study show that the provisions for changing the allocation of waqf land that are carried out without going through the licensing process from the minister of religion and approval from the Indonesian waqf agency (BWI), will give rise to administrative and criminal sanctions, in accordance with Law Number 41 of 2004. Any change in the allocation of waqf land, which is not carried out in accordance with the provisions of Law Number 41 of 2004 will have legal consequences. The case of changing the allocation of waqf land refers to the benefit of the people, even though the reason for maslahah is still mandatory to be fulfilled in accordance with the principle of legal certainty for waqf property. The government needs to increase socialization and education to the public about the importance of registration and procedures for exchanging waqf land, in order to comply with applicable laws.

| Additional Information: | Perubahan peruntukan tanah wakaf madrasah menjadi rumah hunian tanpa izin dari Menteri Agama dan persetujuan dari Badan Wakaf Indonesia. Hal tersebut akan menimbulkan permasalahan dikemudian hari dikarenakan tidak ada kepastian hukum. Penelitian ini bertujuan untuk menganalisis perubahan peruntukan tanah wakaf di Kampung Kepandean, serta menelaah akibat hukumnya. Teori yang digunakan dalam penelitian ini yaitu teori maslahah dan teori kepastian hukum. Metode yang digunakan dalam penelitian ini yaitu metode yuridis empiris, yaitu metode yang dilakukan secara langsung di lapangan dengan menggunakan wawancara langsung dari pihak yang terkait. Kemudian akan dihubungkan dengan peraturan perundang-undangan dan teori hukum yang berlaku saat ini. Hasil penelitian ini menunjukan bahwa ketentuan perubahan peruntukan tanah wakaf yang dilakukan tanpa melalui proses perizinan dari menteri agama dan persetujuan dari badan wakaf Indonesia (BWI), akan menimbulkan sanksi administratif dan pidana, sesuai dengan Undang-Undang Nomor 41 Tahun 2004. Adanya perubahan peruntukan tanah wakaf, yang tidak dilakukan sesuai dengan ketentuan Undang-Undang Nomor 41 Tahun 2004 akan berakibat hukum. Kasus perubahan peruntukan tanah wakaf mengacu kepada kemanfaatan demi kepentingan umat, kendati alasan maslahah, prosedur formal tetap wajib dipenuhi agar sesuai dengan asas kepastian hukum terhadap harta wakaf. Pemerintah perlu meningkatkan sosialisasi dan edukasi kepada masyarakat mengenai pentingnya pendaftaran dan prosedur tukar menukar tanah wakaf, agar sesuai dengan hukum yang berlaku. | |||||||||
