Abstract

The development of the digital economy has led to the emergence of professions such as content creators and affiliates, particularly within the Shopee e-commerce through the Shopee Affiliate program. However, legal issues arise when affiliates upload content owned by creators without permission for commercial purposes. This study identifies two main issues: first, how legal protection for content creators is provided under Law No. 28 of 2014 on Copyright, and second, the form of legal responsibility that can be imposed on Shopee affiliates. This research employs a juridical-normative approach using literature review and interviews, as well as an analysis of relevant regulations and the Shopee Affiliate’s electronic contract. The findings indicate that legal protection for content creators can be provided both preventively and repressively, although its implementation in practice remains hindered. Affiliates who upload content without permission can be held legally responsible for unlawful acts that result in harm to content creators, including both material and immaterial losses. Furthermore, affiliates are also contractually liable to Shopee for breaching the terms and conditions of the Shopee Affiliate program, which may lead to administrative sanctions. This study underscores the importance of enhancing digital legal education, strengthening platform oversight, and enforcing robust legal protections to safeguard copyrights in the digital realm.

Additional Information: Perkembangan ekonomi digital mendorong hadirnya profesi konten kreator dan afiliator, khususnya dalam e-commerce Shopee melalui program Shopee Affiliate. Namun, muncul permasalahan hukum ketika afiliator melakukan pengunggahan ulang konten milik kreator tanpa izin untuk tujuan komersial. Penelitian ini mengidentifikasi dua pokok masalah, yakni bagaimana perlindungan hukum bagi konten kreator berdasarkan Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta, dan bagaimana bentuk tanggung jawab hukum yang dapat dikenakan kepada afiliator Shopee. Penelitian ini menggunakan pendekatan yuridis normatif dengan studi kepustakaan dan wawancara, serta analisis terhadap peraturan perundang-undangan dan kontrak elektronik Shopee Affiliate. Hasil penelitian menunjukkan bahwa perlindungan hukum terhadap konten kreator dapat diberikan secara preventif dan represif, meskipun implementasinya di lapangan masih terkendala. Afiliator yang terbukti mengunggah ulang konten tanpa izin dapat dimintai tanggung jawab hukum atas dasar perbuatan melawan hukum yang menimbulkan kerugian bagi konten kreator, termasuk kerugian materiil dan imateriil. Selain itu, afiliator juga bertanggung jawab secara kontraktual terhadap Shopee karena melanggar syarat dan ketentuan program Shopee Affiliate, yang dapat menimbulkan sanksi administratif. Penelitian ini mendorong pentingnya peningkatan edukasi hukum digital, pengawasan platform, dan penegakan hukum yang tegas untuk melindungi hak cipta di ruang digital.
