Abstract
Regional Head Elections (Pilkada) are a tangible manifestation of democratic principles at the local level. The city of Cilegon is one of the regions facing serious issues related to the neutrality of Civil Service Officials (ASN) ahead of the 2024 Simultaneous Regional Head Elections. Violations of the principle of ASN neutrality have been recorded at a fairly high rate, despite being regulated in various laws and regulations. This reality underscores the importance of evaluating the implementation of supervisory functions by the Election Supervisory Agency (Bawaslu). The issues in this study are formulated into two main focuses: the implementation of Bawaslu's authority in supervising ASN neutrality and the obstacles encountered in its implementation. This study uses oversight theory to understand control mechanisms and law enforcement theory to examine the implementation of sanctions for violations of civil servant neutrality. The research method employed is a legal-empirical approach with a qualitative focus. Data collection techniques include literature review, field observation, and interviews with members of the Cilegon City Bawaslu and several civil servants as research subjects. The results of the study indicate that the Cilegon City Bawaslu has exercised its authority in accordance with Law Number 10 of 2016. However, its implementation has not been fully effective. Obstacles were found in the form of limited human resources, a lack of understanding among ASN regarding the principle of neutrality, and structural and cultural pressures that affect the independence of supervision.

| Additional Information: | Pemilihan Kepala Daerah (Pilkada) merupakan manifestasi nyata dari prinsip demokrasi di tingkat lokal. Kota Cilegon menjadi salah satu daerah yang menghadapi persoalan serius terkait netralitas Aparatur Sipil Negara (ASN) menjelang Pilkada Serentak 2024. Pelanggaran terhadap asas netralitas ASN tercatat cukup tinggi, meskipun telah diatur dalam berbagai regulasi perundang-undangan. Realitas tersebut mendorong pentingnya evaluasi terhadap pelaksanaan fungsi pengawasan oleh Badan Pengawas Pemilihan Umum (Bawaslu). Permasalahan dalam penelitian ini dirumuskan ke dalam dua fokus utama, yaitu pelaksanaan kewenangan Bawaslu dalam mengawasi netralitas ASN dan hambatan-hambatan yang muncul dalam pelaksanaannya. Kajian ini menggunakan teori pengawasan untuk memahami mekanisme kontrol dan teori penegakan hukum untuk menelaah pelaksanaan sanksi terhadap pelanggaran netralitas ASN. Metode yang digunakan dalam penelitian ini adalah yuridis-empiris dengan pendekatan kualitatif. Teknik pengumpulan data dilakukan melalui studi kepustakaan, observasi lapangan, serta wawancara terhadap anggota Bawaslu Kota Cilegon dan beberapa ASN sebagai objek penelitian. Hasil penelitian menunjukkan bahwa Bawaslu Kota Cilegon telah menjalankan kewenangan sesuai Undang-Undang Nomor 10 Tahun 2016. Namun implementasinya belum sepenuhnya efektif. Ditemukan kendala berupa keterbatasan SDM, kurangnya pemahaman ASN terhadap prinsip netralitas, serta tekanan struktural dan kultural yang mempengaruhi independensi pengawasan. | |||||||||
