Abstract
Indonesia’s strategic geographical position makes it a key destination for international mobility, whether for economic, social, or political purposes. This necessitates a strong and effective immigration system to monitor the movement of foreigners within Indonesian territory. The Immigration Office, including the Class I Non-TPI Immigration Office in Serang City, holds an important mandate in enforcing administrative measures against foreigners who violate immigration laws. This study aims to examine how the administrative authority is implemented and what obstacles are encountered in its execution. The research employs an empirical juridical method with a qualitative approach, combining literature study with field research through interviews and observations. The analysis is based on the Theory of Authority and the Theory of Law Enforcement. The findings indicate that administrative immigration actions such as deportation and residence permit revocation have been carried out in accordance with Law Number 6 of 2011 concerning Immigration. However, challenges remain, including lack of procedural transparency, limited human resources, and low public participation in reporting immigration violations. In conclusion, the Class I Non-TPI Immigration Office in Serang City possesses adequate authority to implement administrative actions against foreigners. Nonetheless, to enhance effectiveness, improvements are needed in procedural transparency, human resource capacity, and collaboration with the community. This study is expected to contribute both theoretically and practically to the development of immigration policy in Indonesia.

| Additional Information: | Posisi geografis Indonesia yang strategis menjadikannya sebagai tujuan utama mobilitas internasional, baik untuk tujuan ekonomi, sosial, maupun politik. Hal ini menuntut sistem keimigrasian yang kuat dan efektif dalam mengawasi lalu lintas orang asing di wilayah Indonesia. Kantor Imigrasi sebagai lembaga pelaksana fungsi keimigrasian, termasuk Kantor Imigrasi Kelas I Non TPI Kota Serang, memiliki kewenangan penting dalam menerapkan tindakan administratif terhadap orang asing yang tidak mematuhi peraturan perundang-undangan. Penelitian ini mengidentifikasi dua permasalahan utama: bagaimana pelaksanaan kewenangan tindakan administratif oleh Kantor Imigrasi Kelas I Non TPI Kota Serang dan apa hambatan yang dihadapi dalam pelaksanaannya. Teori yang digunakan sebagai kerangka analisis adalah Teori Kewenangan dan Teori Penegakan Hukum. Metode penelitian yang digunakan adalah yuridis empiris, dengan pendekatan kualitatif yang menggabungkan studi pustaka dan studi lapangan melalui wawancara dan observasi. Hasil penelitian menunjukkan bahwa pelaksanaan tindakan administratif keimigrasian, seperti deportasi dan pembatalan izin tinggal, telah dilakukan sesuai dengan ketentuan dalam Undang-Undang Nomor 6 Tahun 2011 tentang Keimigrasian. Ditemukan hambatan berupa kurangnya transparansi prosedur, keterbatasan sumber daya manusia, serta rendahnya partisipasi masyarakat dalam pelaporan pelanggaran keimigrasian. Kesimpulan dari penelitian ini adalah bahwa Kantor Imigrasi Kelas I Non TPI Kota Serang memiliki kewenangan yang cukup dalam melaksanakan tindakan administratif terhadap orang asing. Namun, untuk meningkatkan efektivitasnya, dibutuhkan perbaikan pada aspek transparansi, kapasitas sumber daya manusia, dan kolaborasi dengan masyarakat. Penelitian ini diharapkan memberikan kontribusi teoritis dan praktis terhadap pengembangan kebijakan imigrasi di Indonesia. | |||||||||
