Abstract

Employee disputes are disputes in the field of State Administration that arise due to the existence of a State Administrative Decision by an authorized official in the field of personnel regarding the position, obligations, rights and development of Civil Servants. In this study, an in-depth analysis is needed regarding how the legal review of the decision of the state administrative court number 31/G/2021/PTUN.srg regarding employee disputes? So this study aims to analyze the law and legal consequences of the granting of decision number 31/G/2021/PTUN.srg. The theories used in this study are the theory of resolving state administrative disputes and the theory of government action. This research method uses the Normative Juridical method, with a statutory approach, a conceptual approach, and a case approach. The data sources are secondary data as the main data and primary data as supporting data. The data analysis uses qualitative descriptive data analysis. Decree of the Chancellor of UIN Syarif Hidayatullah Jakarta Number: 168 of 2021 concerning the Honorable Dismissal of Prof. Dr. Andi M. Faisal Bakti, M.A, from the position of Vice Chancellor for Cooperation at UIN Syarif Hidayatullah Jakarta for the 2019-2023 term of office, dated February 18, 2021. The Panel of Judges at the first instance, based on all legal considerations, proved that there were procedural and substantive defects in the issuance of the a quo disputed object in conflict with the Regulation of the Minister of Religion of the Republic of Indonesia Number 17 of 2014 concerning the Statutes of the Syarif Hidayatullah State Islamic University of Jakarta. The Panel of Judges is of the opinion that the issuance of the a quo disputed object has conflicted with the Laws and Regulations as referred to in the provisions of Article 23 paragraph (4) and Article 26 of Government Regulation Number 53 of 2010 concerning Employee Discipline Article 53 paragraph (2) letter a of Law Number 9 of 2004 concerning Amendments to Law Number 5 of 1986. The execution of the ruling has not been fully implemented because the Defendant and the Audit Board (BPK) reinterpreted the amount, which should have been Rp180,000,000.00. Therefore, supervision by the Administrative Court is necessary to ensure full execution in the interest of justice and legal certainty.

Additional Information: Sengketa kepegawaian merupakan sengketa dalam bidang Tata Usaha Negara yang timbul akibat adanya Keputusan Tata Usaha Negara oleh pejabat yang berwenang dalam bidang kepegawaian mengenai kedudukan, kewajiban, dan hak Pegawai Negeri Sipil. Seperti halnya putusan nomor 31/G/2021/PTUN.srg mengnai sengketa kepegawaian kepecatan secara homat dari wakil rektor UIN Syarif Hidayatullah. Sehingga penelitian ini bertujuan untuk menganalisis hukum dan akibat hukum terkabulnya putusan nomor 31/G/2021/PTUN.srg. Teori yang digunakan dalam penelitian ini yaitu teori penyelesaian sengketa tata usaha negara dan teori tindakan pemerintah. Metode Penelitian ini menggunakan metode Yuridis Normatif, dengan pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan kasus. Sumber data berupa data sekunder sebagai data utama dan data primer sebagai penunjang. Analisis datanya menggunakan analisis data deskrptif kualitatif. Hasil Penelitian ini menunjukan sengketa objek Surat Keputusan Rektor UIN Syarif Hidayatullah Jakarta Nomor: 168 Tahun 2021 tentang Pemberhentian dengan hormat Prof. Dr. Andi M. Faisal Bakti, M.A, dari Jabatan Wakil Rektor Bidang Kerjasama UIN Syarif Hidayatullah Jakarta Masa Jabatan Tahun 2019-2023, tanggal 18 Februari 2021. Majelis Hakim tingkat pertama berdasarkan keseluruhan pertimbangan hukum, terbukti adanya cacat prosedur dan substantif penerbitan objek sengketa a quo bertentangan dengan Peraturan Menteri Agama Republik Indonesia Nomor 17 Tahun 2014 dan Peraturan Pemerintah Nomor 53 Tahun 2010 Tentang Disiplin Pegawai Pasal 53 ayat (2) huruf a Undang-Undang Nomor 9 Tahun 2004. Namun, hingga kini pelaksanaan penetapan eksekusi tidak dilaksankan seutuhnya karena Tergugat dan BPK menafsirkan ulang besaran nominal yang seharusnya Rp180.000.000,00. Rekomendasi diperlukan pengawasan dari Pengadilan Tata Usaha Negara agar eksekusi berjalan sepenuhnya demi keadilan dan kepastian hukum.
