Abstract
The Constitutional Court Decision Number 2/MKMK/L/11/2023 concerning violations of the judge's code of ethics is evidence that there are problems that occur in the decision-making of the Constitutional Court Number 90/PUU-XXI/2023 concerning the age limit of presidential and vice presidential candidates related to the family relationship between constitutional judges and vice presidential candidates. The problems are: First, the Legitimacy of the Vice President-Elect After the Decision of the Constitutional Court's Ethics Council Number 2/MKMK/L/11/2023. Second, the Implications of the Decision of the Constitutional Court's Ethics Council on the Constitutional Court's Decision Number 90/PUU-XXI/2023. This study uses a qualitative method with a normative legal approach. With the Research Data Source, namely secondary data sources. The results of the study show that Gibran did not fully obtain political legitimacy because to obtain it he must comply with political ethics. While in terms of moral legitimacy, Gibran does not have legitimacy. Moral and ethical questions regarding the process of its emergence have raised concerns about the increasingly elitist direction of democracy because the issue of morality in politics is not only the legality or otherwise of actions according to law, but also about values, ethics, and social justice. The Constitutional Court's decision is Final and Binding so that the MKMK Decision Number 2 / MKMK / L / 11/2023 does not have legal implications for the Constitutional Court Decision Number 90 / PUU-XXI / 2023 due to the limited authority of the MKMK and the special nature of the Constitutional Court's decision.

| Additional Information: | Putusan MK Nomor 2/MKMK/L/11/2023 mengenai pelanggaran kode etik hakim menjadi bukti bahwa adanya masalah yang terjadi dalam pengambilan putusan MK Nomor 90/PUU-XXI/2023 mengenai batas usia calon presiden dan calon wakil presiden yang kaitannya dengan hubungan kekeluargaan antara hakim konstitusi dengan calon wakil presiden. Masalahnya adalah: Pertama, Legitimasi Wakil Presiden Terpilih Pasca Putusan Majelis Kehormatan Mahkamah Konstitusi Nomor 2/MKMK/L/11/2023. Kedua, Implikasi Putusan Majelis Kehormatan Mahkamah Konstitusi terhadap Putusan Mahkamah Konstitusi Nomor 90/PUU-XXI/2023. Penelitian ini menggunakan metode kualitatif dengan pendekatan yuridis normatif. Dengan Sumber Data Penelitian yakni sumber data sekunder. Hasil penelitian menunjukan bahwa Gibran tidak sepenuhnya memperoleh legitimasi politik karena untuk memperolehnya harus mematuhi etika politik. Sedangkan secara Legitimasi moral Gibran tidak memiliki legitimasi. Pertanyaan moral dan etis mengenai proses kemunculannya telah menimbulakan keresahan akan arah demokrasi yang semakin elitis karena persoalan moralitas dalam politik bukan hanya sah atau tidaknya tindakan menurut hukum, melainkan juga soal nilai, etika, dan keadilan sosial. Putusan MK bersifat Final and Binding sehingga Putusan MKMK Nomor 2/MKMK/L/11/2023 tidak berimplikasi secara yuridis pada putusan MK Nomor 90/PUU-XXI/2023 karena keterbatasan wewenang MKMK dan sifat khusus dari putusan MK. | |||||||||
