Abstract
Narcotics Free Certificate is one of the requirements carried out by the government to find out the existence of drug abuse around us, this Narcotics Free Certificate is a requirement for someone who wants to apply for a job or enroll in college this aims because drug use can affect the performance of someone who works or studies on campus. The identification of problems in this study are first, how is the enforcement of criminal law against perpetrators of criminal acts of falsification of narcotics free certificate? Second, how is criminal liability in dealing with the perpetrators of falsification of narcotics free certificate? The theories used in this research are law enforcement and criminal liability. The method used in this research is the normative juridical method with a statutory approach plus research in the field as supporting data. Based on this research, the results obtained that in enforcing the law using factors that influence law enforcement, namely, law enforcement factors, facilities and infrastructure and the responsibility of perpetrators of abuse of forgery of narcotics-free certificate Article 263 of the Criminal Code concerning forgery of letters and punishable by a maximum of six years. The conclusion of the researcher is that the efforts made by law enforcement officials are preventive, repressive, and criminal liability for falsification of narcotics-free certificate in East Jakarta is imprisonment and fines. The suggestion in this study is that law enforcement officials should be more supervisory and criminal liability is not only for the perpetrators of forgery but also for the authorities who make the certificate.

| Additional Information: | Surat Keterangan Bebas Narkotika merupakan salah satu syarat yang dilakukan pemerintah untuk mengetahui adanya penyalahgunaan narkoba disekitar kita, Surat Keterangan Bebas Narkotika ini merupakan syarat bagi seseorang yang hendak melamar pekerjaan ataupun mendaftar ke perguruan tinggi ini bertujuan dikarenakan pengunaan narkoba dapat mempengaruhi kinerja seseorang yang bekerja ataupun belajar di kampus. Identifikasi masalah pada penelitian ini yaitu yang pertama, bagaimana penegakan hukum pidana terhadap pelaku tindak pidana pemalsuan surat keterangan bebas narkotika? Kedua, bagaimana pertanggungjawaban pidana dalam menangani pelaku pemalsuan surat keterangan bebas narkotika? Teori yang digunakan dalam penelitian ini yaitu penegakan hukum dan pertanggungjawaban pidana. Metode yang digunakan dalam penelitian ini yaitu metode yuridis normatif dengan pendekatan perundang-undangan ditambah penelitian di lapangan sebagai pendukung data. Berdasarkan penelitian ini diperoleh hasil bahwa dalam menegakan hukum menggunakan faktor-faktor yang mempengaruhi penegak hukum yaitu, faktor penegak hukum, sarana dan prasarana dan pertanggungjawaban pelaku penyalahgunaan pemalsuan surat keterangan bebas narkotika Pasal 263 KUHP tentang pemalsuan surat dan diancam pidana paling lama enam tahun. Kesimpulan peneliti adalah upaya yang dilakukan aparat penegakan hukum adalah preventif, represif, dan pertanggungjawaban pidana pemalsuan surat keterangan bebas narkotika di Jakarta Timur adalah penjara dan denda. Saran pada penelitian ini adalah aparat penegak hukum agar lebih mengawasi dan pertanggungjawaban pidana tidak hanya untuk pelaku pemalsuan melaikan pada pihak berwenang yang membuat surat keterangan. | |||||||||
