Abstract
Social Responsibility is one of the contributions companies make to the environment and society. Based on Cilegon Regional Regulation No. 10 of 2012 concerning the Management of Corporate Social Responsibility, it states that “Companies operating in the City of Cilegon in fields and/or related to natural resources are required to fulfill their social and environmental responsibilities.” PT Mahes Jaya Steel, as a company operating in the Cilegon area, is subject to the legal obligation to implement corporate social responsibility. However, in practice, the implementation of corporate social responsibility by PT Mahes Jaya Steel has not yet met the requirements of Cilegon Regional Regulation No. 10 of 2012. Based on this, a study was conducted on how the implementation and regulation of sanctions for corporate social responsibility at PT Mahes Jaya Steel are carried out in accordance with Law No. 40 of 2007 on Limited Liability Companies in conjunction with Cilegon Regional Regulation No. 10 of 2012 on the Management of Corporate Social Responsibility. The method used in this study is a normative-empirical legal approach, utilizing primary data from interviews and secondary data from literature reviews. The data obtained will be analyzed using descriptive-analytical analysis. The research findings indicate that the implementation of corporate social responsibility by PT Mahes Jaya Steel is in accordance with Law No. 40 of 2007 on Limited Liability Companies, However, in its implementation, PT Mahes Jaya Steel has not fully aligned its contributions with Cilegon Regional Regulation No. 10 of 2012, as the form of corporate social responsibility implementation still involves financial donations to the community when they submit proposals to PT Mahes Jaya Steel. Regulations regarding sanctions are stipulated in the applicable laws and regulations, with sanctions that may be imposed including written warnings and restrictions on business activities. It is advisable for PT Mahes Jaya Steel to immediately develop a structured annual strategic plan for corporate social responsibility and communicate this plan to the community, so that the community can also express their needs and aspirations to the company.

| Additional Information: | Tanggung Jawab Sosial merupakan salah satu kontribusi perusahaan terhadap lingkungan dan masyarakat. Berdasarkan Peraturan Daerah Cilegon Nomor 10 Tahun 2012 Tentang Pengelolaan Tanggung Jawab Sosial Perusahaan mengatakan bahwa “Perseroan yang menjalankan kegiatan usahanya di Kota Cilegon pada bidang dan/atau berkaitan dengan sumber daya alam wajib melaksanakan tanggung jawab sosial dan lingkungan”. PT Mahes Jaya Steel sebagai perusahaan yang beroperasi di wilayah Cilegon termasuk dalam subjek hukum yang wajib melaksanakan tanggung jawab sosial perusahaan. Namun, dalam praktiknya pelaksanaan tanggung jawab sosial perusahaan PT Mahes Jaya Steel belum memenuhi ketentuan Peraturan Daerah Cilegon Nomor 10 Tahun 2012. Berdasarkan hal tersebut dilakukan pengkajian bagaimana pelaksanaan dan pengaturan sanksi tanggung jawab sosial PT Mahes Jaya Steel berdasarkan Undang-Undang No. 40 Tahun 2007 tentang Perseroan Terbatas Jo. Peraturan Daerah Cilegon No. 10 Tahun 2012 Tentang Pengelolaan Tanggung Jawab Sosial Perusahaan. Metode yang digunakan dalam penelitian ini adalah yuridis normatif-empiris dengan menggunakan data primer dari wawancara serta data sekunder dari studi kepustakaan. Data yang telah diperoleh akan dianalisa menggunakan analisis deskriptif-analitis. Hasil penelitian menunjukan bahwa dalam pelaksanaan tanggung jawab sosial perusahaan yang dilakukan PT Mahes Jaya Steel telah sesuai dengan undang-undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas, namun dalam pelaksanaannya, PT Mahes Jaya Steel belum sepenuhnya selaras berkontribusi sesuai dengan Peraturan Daerah Cilegon Nomor 10 Tahun 2012, karena melihat bentuk pelaksanaan tanggung jawab sosial perusahaan masih berupa bantuan sumbangan dana kepada masyarakat apabila mengajukan proposal kepada PT Mahes Jaya Steel. Pengaturan mengenai sanksi telah diatur dalam ketentuan perundang-undangan, sanksi yang dapat dikenakan berupa peringatan tertulis dan pembatasan kegiatan usaha. Sebaiknya PT Mahes Jaya Steel segera untuk menyusun rencana strategis tahunan tanggung jawab sosial secara terstruktur dan memberikan sosialisasi rencana tersebut kepada masyarakat, agar masyarakat juga dapat memberikan aspirasi kebutuhannya kepada perusahaan. | |||||||||
