Abstract
The digital era and the use of technology like today make humans more creative and can be a source of income with the works created. Based on Article 40 paragraph (1) letter m of Law Number 28 of 2014 concerning Copyright, cinematography is a work or work that is protected by copyright. But on the other hand, it has an impact on the rampant copyright infringement. One of them is the dissemination of TikTok content @dosenkecantikan without the permission of the creator. Identify the problem, namely how effective the terms and conditions of the TikTok application provider are to protect the content creation on the @dosenkecantikan account and the responsibility of the TikTok application provider for the violation of the content on the @dosenkecantikan account. The theories used are law enforcement theory and responsibility theory. The research method used is empirical juridical with the approach used being a case study approach on legal events in an ongoing state. The data sources used are secondary data and primary data using data collection techniques, literature studies, and field studies and are analyzed in a qualitative descriptive manner. The results of the study show that, in terms of the effectiveness of copyright protection on the TikTok application, it has not been effectively implemented to protect application users from the threat of re-uploading on @dosenkecantikan accounts, the lack of sanctions is one of the factors that are still rampant copyright infringement on the TikTok application. The TikTok application service provider will be fully responsible for the occurrence of violations of the content on @dosenkecantikan account in accordance with the principle of absolute responsibility. TikTok will be committed to helping remove video content on other parties' accounts that re-upload and permanently block violators. The TikTok application must maximize and effectively implement the terms and conditions of service for users. In particular, implementing digital content copyright protection and collaborating with the DJKI with socialization or supervision to prevent or reduce copyright problems.

| Additional Information: | Era digital dan pemanfataan teknologi seperti sekarang ini membuat manusia menjadi lebih kreatif dan dapat menjadikan sumber penghasilan dengan karya yang diciptakan. Berdasarkan Pasal 40 ayat (1) huruf m Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta, sinematografi merupakan suatu ciptaan atau karya yang dilindungi oleh hak cipta. Namun di sisi lain berdampak pada maraknya pelanggaran hak cipta. Salah satunya adalah penyebarluasan konten TikTok @dosenkecantikan tanpa seizin penciptanya. Identifikasi masalah yaitu bagaimana efektifitas syarat dan ketentuan pada penyedia aplikasi TikTok untuk melindungi ciptaan konten pada akun @dosenkecantikan dan tanggung jawab penyedia aplikasi TikTok atas terjadinya pelanggaran atas konten pada akun @dosenkecantikan. Teori yang digunakan yaitu teori penegakan hukum dan teori tanggungjawab. Metode penelitian yang digunakan yaitu yuridis empiris dengan pendekatan yang digunakan adalah pendekatan studi kasus pada peristiwa hukum dalam keadaan berlangsung. Sumber data yang digunakan adalah data sekunder dan data primer dengan menggunakan teknik pengumpulan data studi kepustakaan dan studi lapangan serta dianalisis secara deskriptif kualitatif. Hasil penelitian menunjukan bahwa, dalam hal efektifitas perlindungan hak cipta pada aplikasi TikTok, belum terimplementasi secara efektif untuk melindungi pengguna aplikasi dari ancaman pengunggahan ulang pada akun @dosenkecantikan, minimnya sanksi menjadi salah satu faktor masih maraknya pelanggaran hak cipta di aplikasi TikTok. Penyedia jasa aplikasi TikTok akan secara penuh bertanggung jawab atas terjadinya pelanggaran atas konten pada akun @dosenkecantikan sesuai dengan prinsip tanggung jawab mutlak. TikTok akan berkomitmen untuk membantu penghapusan konten-konten video pada akun pihak lain yang melakukan pengunggahan ulang dan pemblokiran secara permanen bagi pelanggar. Aplikasi TikTok harus memaksimalkan dan mengefektifitaskan syarat dan ketentuan layanan untuk para pengguna. Khususnya melaksanakan perlindungan hak cipta konten digital serta melakukan kerja sama dengan pihak DJKI dengan sosialisasi atau pengawasan guna mencegah ataupun mengurangi permasalahan-permasalahan hak cipta. | |||||||||
