Abstract
Public information disputes are caused by the non-fulfilment of information requests by public bodies. Requesting a dispute to the Information Commission is permissible under the law, but the problem that occurs is that information requesters submit a large number of information requests to Public Bodies and submit them at the same time without having a direct interest in the information requested. Based on Article 4 paragraph (3) of Information Commission Regulation Number 1 of 2013 concerning Procedures for Settling Public Information Disputes, the Information Commission is authorised to apply vexatious requests and stop the dispute resolution process. The identification of the problem formulated is how the effectiveness of the application of vexatious requests against requests for information disputes that are not carried out in earnest and good faith and how obstacles to the effectiveness of the application of vexatious requests against such information requests. The theories used are the theory of authority and the theory of legal effectiveness. The method used is empirical juridical with primary and secondary data sources through interview data collection techniques and literature study. The results of the research conducted obtained that the effectiveness of the application of vexatious requests which is the authority of the Banten Provincial Information Commission against requests for disputes that are not carried out in earnest and good faith is still not effective because of obstacles originating from internal and external obstacles, namely the inconsistency of the Information Commission Commissioners, Public Bodies that are less responsive, and the lack of public understanding of public information disclosure including how to request information according to statutory regulations. The obstacle to the effectiveness of the application of vexatious requests by the Information Commission itself is that the filing of information disputes is misused to blackmail public bodies by stopping the dispute resolution process, thus undermining the value of public information disclosure.

| Additional Information: | Sengketa informasi publik disebabkan oleh tidak dipenuhinya permintaan informasi oleh Badan Publik. Permohonan sengketa kepada Komisi Informasi merupakan suatu hal yang dibolehkan menurut undang-undang akan tetapi permasalahan yang terjadi adalah pemohon informasi yang mengajukan permohonan informasi kepada Badan Publik yang jumlahnya besar dan diajukan dalam waktu yang bersamaan tanpa mempunyai unsur kepentingan langsung atas informasi yang diminta. Berdasarkan pasal 4 ayat (3) Peraturan Komisi Informasi Nomor 1 Tahun 2013 Tentang Prosedur Penyelesaian Sengketa Informasi Publik, Komisi Informasi berwenang untuk menerapkan vexatious request dan menghentikan proses penyelesaian sengketa. Identifikasi masalah yang dirumuskan yaitu bagaimana efektivitas penerapan vexatious request terhadap permohonan sengketa informasi yang tidak dilakukan dengan sungguh-sungguh dan itikad baik dan bagaimana hambatan efektivitas penerapan vexatious request terhadap permohonan informasi yang demikian. Teori yang digunakan yaitu teori kewenangan dan teori efektivitas hukum. Metode yang digunakan yaitu yuridis empiris dengan sumber data primer dan sekunder melalui teknik pengumpulan data wawancara dan studi kepustakaan. Hasil dari penelitian yang dilakukan diperoleh bahwa efektivitas penerapan vexatious request yang merupakan kewenangan komisi informasi Provinsi Banten terhadap permohonan sengketa yang tidak dilakukan dengan sungguh-sungguh dan itikad baik masih belum efektif karena kendala yang berasal dari internal dan eksternal yaitu inkonsistensi Komisioner Komisi Informasi, Badan Publik yang kurang responsif, dan pemahaman masyarakat yang masih kurang terhadap keterbukaan informasi publik termasuk cara melakukan permohonan informasi menurut peraturan perundang-undangan. Hambatan efektivitas penerapan vexatious request oleh Komisi Informasi sendiri adalah pengajuan sengketa informasi disalahgunakan untuk memeras Badan Publik dengan cara menghentikan proses penyelesaian sengketa sehingga menciderai nilai dari keterbukaan informasi publik. | |||||||||
