Abstract
Article 89 paragraph (1) of the Regulation of the Minister of Home Affairs (Permendagri) Number 80 of 2015 concerning the Formation of Regional Legal Products states that "Facilitation carried out by the Minister of Home Affairs through the Director General of Regional Autonomy for provinces and governors for districts/cities as referred to in Article 88 paragraph (1) and paragraph (3) is carried out no later than 15 (fifteen) days after receiving the draft regional regulation, draft regional regulation, draft PB KDH or draft DPRD regulation". But in fact, the process of facilitating the draft regional regulation for the Regency/City carried out by the Legal Bureau of the Banten Provincial Secretariat took more than 15 working days. The identification of the problem from this study is how the implementation of the facilitation of the Draft Regional Regulation for the Regency/City by the Legal Bureau of the Banten Provincial Secretariat, and what are the obstacles and constraints of the Legal Bureau of the Banten Provincial Secretariat in implementing the Facilitation of the Draft Regional Regulation. The theories used are the Theory of Legislation and the Theory of Regional Autonomy. The research method uses normative juridical and empirical juridical with analytical descriptive research specifications and Legislation, and uses primary data sources in the form of interviews, and secondary data sources in the form of literature, as well as qualitative techniques to analyze data obtained descriptively analytically. The conclusion of the implementation of the facilitation of the Regency/City Regional Regulation Draft by the Legal Bureau of the Banten Provincial Secretariat has followed the stages regulated in the Minister of Home Affairs Regulation Number 80 of 2015, which has been amended through the Minister of Home Affairs Regulation Number 120 of 2018 for facilitation through the e-Perda system to facilitate the submission of facilitation proposals. However, for the facilitation time, some are under 15 working days, some are 15 working days, above 15 working days up to 1 year. The obstacles and constraints of the Banten Provincial Secretariat Legal Bureau in implementing the Raperda Facilitation are, the lack of human resources and the obstacles to proposals from the district/city government.

| Additional Information: | Pasal 89 ayat (1) Peraturan Menteri Dalam (Permendagri) Negeri Nomor 80 Tahun 2015 Tentang Pembentukan Produk Hukum Daerah menyebutkan bahwa “Fasilitasi yang dilakukan oleh Menteri Dalam Negeri melalui Direktur Jenderal Otonomi Daerah bagi provinsi dan gubernur bagi kabupaten/kota sebagaimana dimaksud dalam Pasal 88 ayat (1) dan ayat (3) dilakukan paling lama 15 (lima belas) hari setelah diterima rancangan perda, rancangan perkada, rancangan PB KDH atau rancangan peraturan DPRD”. Tetapi pada faktanya proses fasilitasi rancangan perda Kabupaten/Kota yang dilakukan Biro Hukum Sekretariat Daerah Provinsi Banten dilakukan lebih dari 15 hari kerja. Adapun identifikasi masalah dari penelitian ini adalah Bagaimana pelaksanaan fasilitasi Raperda Kabupaten/Kota oleh Biro Hukum Sekretariat Daerah Provinsi Banten, dan Bagaimana hambatan dan kendala Biro Hukum Sekretariat Daerah Provinsi Banten dalam melaksanakan Fasilitasi Raperda. Teori yang digunakan Teori Peraturan Perundang-undangan dan Teori Otonomi Daerah. Metode penelitian menggunakan yuridis normatif dan yuridis empiris dengan spesifikasi penelitian deskriptif analitis dan Perundang-undangan, dan menggunakan sumber data primer berupa wawancara, dan sumber data sekunder berupa kepustakaan, serta teknik kualitatif menganalisis data yang diperoleh secara deskriptif analitis. Kesimpulan dari pelaksanaan fasilitasi Raperda Kabupaten/Kota oleh Biro Hukum Sekretariat Daerah Provinsi Banten telah mengikuti tahapan-tahapan yang diatur dalam Permendagri Nomor 80 Tahun 2015, yang telah diubah melalui Permendagri Nomor 120 Tahun 2018 untuk fasilitasi melalui sistem e-Perda guna mempermudah pengajuan usulan fasilitasi. Namun untuk waktu fasilitasi ada yang dibawah 15 hari kerja, ada 15 hari kerja, diatas 15 hari kerja sampai dengan 1 tahun. Hambatan dan kendala Biro Hukum Sekretariat Daerah Provinsi Banten dalam melaksanakan Fasilitas Raperda yaitu, kurangnya sumber daya manusia serta adanya kendala usulan dari pemerintah kabupaten/kota. | |||||||||
