Abstract
This research is motivated by the reality that the retributive criminal justice system in Indonesia has not fully addressed the need for substantive justice for victims, offenders, and society. The focus on punishment often overlooks aspects of victim recovery and offender reintegration, ultimately failing to resolve the root of social problems. The phenomenon of prison overcrowding, accompanied by high recidivism rates, underscores the urgency for a more humane and participatory legal approach. In this context, restorative justice emerges as an alternative to criminal case resolution, emphasizing dialogue, accountability, and the restoration of relationships. This study aims to compare the implementation of restorative justice in Indonesia and Scotland, identifying similarities and differences, as well as analyzing the various barriers to its implementation in both countries. The research uses a normative juridical method with a comparative legal approach. Data were obtained through literature review of legislation, legal doctrines, public policies, and relevant academic literature. The findings show that Scotland has developed an integrated and consistent system for implementing restorative justice, supported by clear regulations such as the Guidance for the Delivery of Restorative Justice in Scotland. Meanwhile, the implementation in Indonesia remains fragmented, lacking a unified legal framework, and have adequate institutional support. This study recommends the development of comprehensive national regulations and the establishment of coordinated mechanisms among law enforcement agencies to strengthen the effective and sustainable implementation of restorative justice in Indonesia.

| Additional Information: | Penelitian ini dilatarbelakangi oleh realitas bahwa sistem pemidanaan yang bersifat retributif di Indonesia belum sepenuhnya mampu menjawab kebutuhan keadilan substantif bagi korban, pelaku, maupun masyarakat. Fokus pada penghukuman sering kali mengesampingkan aspek pemulihan korban serta reintegrasi pelaku, yang pada akhirnya tidak menyelesaikan akar persoalan sosial. Fenomena overkapasitas lembaga pemasyarakatan, disertai tingginya angka residivisme, memperkuat urgensi akan pendekatan hukum yang lebih humanis dan partisipatif. Dalam konteks ini, keadilan restoratif hadir sebagai alternatif penyelesaian perkara pidana yang menitikberatkan pada dialog, tanggung jawab, dan pemulihan hubungan. Penelitian ini bertujuan untuk membandingkan implementasi keadilan restoratif antara Indonesia dan Skotlandia baik persamaan ataupun perbedaan dalam penerapan keadilan restorative yang ada, serta menganalisis berbagai faktor penghambat pelaksanaannya di kedua negara. Metode yang digunakan adalah penelitian hukum yuridis normatif dengan pendekatan perbandingan hukum. Data diperoleh melalui studi pustaka terhadap peraturan perundang-undangan, doktrin hukum, kebijakan publik, dan literatur akademik yang relevan. Hasil penelitian menunjukkan bahwa Skotlandia telah memiliki sistem yang terintegrasi dan konsisten dalam penerapan keadilan restoratif, dengan dukungan regulasi yang jelas seperti Guidance for the Delivery of Restorative Justice in Scotland. Sementara itu, implementasi di Indonesia masih terfragmentasi, tidak memiliki kerangka hukum tunggal, dan belum mendapat dukungan kelembagaan yang memadai. Penelitian ini merekomendasikan penyusunan regulasi nasional yang komprehensif dan pembentukan mekanisme koordinatif antar lembaga penegak hukum guna memperkuat penerapan keadilan restoratif secara efektif dan berkelanjutan di Indonesia. | |||||||||
