Abstract
Design is an important thing in product manufacturing resulting in many new designs that are diverse with their own uniqueness. Design can also have legal protection that is categorized into industrial design. Legal protection is carried out to protect Rights Holders and Designers from industrial design violations including imitation. The design of Crocs sandals and Casio watches are examples of products whose manufacture is imitated. This is done by SMEs which results in violation of the exclusive rights of Designers and Rights Holders based on Law Number 31 of 2000 concerning Industrial Design. The exclusive right to industrial design is to prohibit others who without permission make, use, sell, import, export, and/or distribute goods that are granted industrial design rights. The identification of the problem in this study is How is the legal awareness of SME actors towards industrial design protection, especially the design of Crocs sandals and Casio watches and How is the responsibility of SME actors towards product manufacturing so that they commit violations especially those related to imitation of existing designs. The theory used is the theory of legal awareness and the theory of legal responsibility. The research method used is the empirical normative method, with a qualitative descriptive research type. The results of the study show that the legal awareness of SMEs that produce designs similar to Crocs sandals and Casio watches is still low in all indicators due to the lack of knowledge of SMEs regarding Industrial Design protection regulations, especially those related to these products, resulting in violations of the exclusive rights of Industrial Design. SMEs do not carry out their responsibilities for design violations that occur so that the legal consequences that arise are not in line with the provisions of the Law.

| Additional Information: | Desain merupakan hal penting dalam pembuatan produk mengakibatkan banyaknya desain baru yang beragam dengan keunikannya masing-masing. Desain juga dapat mempunyai perlindungan hukum yang dikategorikan ke dalam desain industri. Perlindungan hukum dilakukan untuk melindungi Pemegang Hak dan Pendesain dari pelanggaran desain industri termasuk peniruan. Desain produk sandal Crocs dan jam tangan Casio merupakan contoh produk yang ditiru pembuatannya. Hal ini dilakukan oleh UKM yang mengakibatkan pelanggaran atas hak eksklusif Pendesain dan Pemegang Hak berdasarkan Undang-Undang Nomor 31 Tahun 2000 tentang Desain Industri. Hak eksklusif desain industri adalah melarang orang lain yang tanpa persetujuan yaitu membuat, memakai, menjual, mengimpor, mengekspor, dan/atau mengedarkan barang yang diberi hak desain industri. Identifikasi masalah dalam penelitian ini adalah Bagaimana kesadaran hukum pelaku UKM terhadap perlindungan desain industri, khususnya desain produk sandal Crocs dan jam tangan Casio dan Bagaimana tanggung jawab Pelaku UKM terhadap pembuatan produk sehingga melakukan perbuatan melanggar khususnya yang berkaitan dengan peniruan desain yang telah ada. Teori yang digunakan adalah teori kesadaran hukum dan teori tanggung jawab hukum. Metode penelitian yang digunakan adalah metode normatif empiris, dengan jenis penelitian deskriptif kualitatif. Hasil dari penelitian bahwa kesadaran hukum pelaku UKM yang memproduksi desain mirip dengan produk sandal Crocs dan jam tangan Casio masih rendah di seluruh indikator disebabkan oleh kurangnya pengetahuan UKM mengenai peraturan perlindungan Desain Industri, khususnya yang berkaitan dengan produk-produk tersebut, sehingga terjadi pelanggaran terhadap hak eksklusif Desain Industri. UKM tidak menjalankan tanggung jawabnya atas pelanggaran desain yang terjadi sehingga akibat hukum yang timbul pun tidak sejalan dengan ketentuan Undang-Undang | |||||||||
