Abstract
This research discusses the protection of cultural heritage during armed conflict and peacetime based on the 1954 Hague Convention, with a focus on the implementation of the Blue Shield Emblem in Indonesia. Cultural heritage as part of civilian objects has special protection under international humanitarian law, and the 1954 Hague Convention regulates the use of the Blue Shield Emblem as a sign of international protection. This research uses a normative legal approach by examining primary and secondary legal sources, as well as case studies of the application of the symbol at several national sites. The results show that although Indonesia has ratified the convention, the implementation of the Blue Shield Emblem has not run optimally. Normative regulatory barriers, weaknesses in inter- agency coordination, and lack of public awareness are dominant factors in the implementation of the Blue Shield Emblem for national cultural heritage. Therefore, there is a need to strengthen the national legal framework and establish coordinative institutions so that the protection of cultural heritage in Indonesia is more effective and has international standards.

| Additional Information: | Perlindungan cagar budaya pada masa konflik bersenjata dan masa damai berdasarkan Konvensi Den Haag 1954, dengan fokus pada implementasi Blue Shield Emblem di Indonesia. Cagar budaya sebagai bagian dari objek sipil memiliki perlindungan khusus menurut hukum humaniter internasional, dan Konvensi Den Haag 1954 mengatur penggunaan Blue Shield Emblem sebagai tanda perlindungan internasional. Penelitian ini menggunakan pendekatan hukum normatif dengan mengkaji sumber hukum primer dan sekunder, serta studi kasus penerapan simbol tersebut di beberapa situs nasional. Hasil penelitian menunjukkan bahwa meskipun Indonesia telah meratifikasi konvensi tersebut, implementasi Blue Shield Emblem belum berjalan secara maksimal. Hambatan peraturan secara normatif, kelemahan koordinasi antar-lembaga, dan kurangnya kesadaran masyarakat menjadi faktor dominan pada implementasi Blue Shield Emblem untuk cagar budaya Nasional. Oleh karena itu, dibutuhkan penguatan kerangka hukum nasional dan pembentukan lembaga koordinatif agar perlindungan cagar budaya di Indonesia lebih efektif dan memiliki standarinternasional. | |||||||||
