Abstract
Technological advancements bring significant changes in people's lives. One thing that has changed is the use of electronic media in reaching agreements. This has an influence on the usage of electronic signatures as a method of authentication and identification for electronic documents. The aim of this research is to better comprehend the legal status of electronic signatures in statutory rules. Aside from that, the aim of this research is to provide a more indepth explanation of the fundamental concerns concerning the legitimacy of electronic signatures under civil procedure law. This is a qualitative study conducted utilizing normative legal methods, with data gathered through a literature study. The research findings show the Law on Electronic Information and Transactions has improved the legal certainty of electronic signatures. However, there is a normative contradiction between this Law and the Civil Code. In general, this is an undeniable problem because the Civil Code is out of date. To synchronize all legal rules, a new civil procedural laws must be established. This is done to standardize protection of individuals against issues caused by technological advances that arise. The synchronization of legal regulations can help to confirm the legal status of electronic signatures as evidence under civil procedural law.

| Additional Information: | Perkembangan teknologi membawa dinamika perubahan terhadap kehidupan masyarakat. Salah satu yang mengalami perubahan adalah penggunaan media elektronik dalam melakukan suatu perjanjian. Hal tersebut juga berdampak pada penggunaan tanda tangan elektronik sebagai bentuk pengesahan sekaligus tanda identitas pada dokumen elektronik. Penelitian ini bertujuan untuk memahami kedudukan hukum tanda tangan elektronik dalam peraturan perundang-undangan. Selain itu, penelitian ini juga bertujuan untuk menguraikan lebih lanjut dasar permasalahan aspek legalitas tanda tangan elektronik dalam hukum acara perdata. Penelitian ini merupakan penelitian kualitatif menggunakan metode yuridis normatif yang datanya didapatkan melalui studi kepustakaan. Hasil penelitian menunjukan, dibentuknya Undang-Undang tentang Informasi dan Transaksi Elektronik membawa dampak positif terhadap kepastian hukum tanda tangan elektronik. Meskipun demikian, terdapat pertentangan normatif antara UndangUndang tersebut dengan KUHPerdata. Secara umum, hal ini menjadi permasalahan yang tidak dapat dibantahkan karena eksistensi KUHPerdata yang sudah ketinggalan zaman. Agar mensinkronkran setiap aturan hukum maka diperlukan adanya pembentukan hukum acara perdata yang baru. Hal ini dilakukan untuk menormakan perlindungan kepada individu dari permasalahan yang diakibatkan oleh perkembangan teknologi yang terjadi. Sinkronisasi aturan hukum tersebut dapat semakin menegaskan legal standing tanda tangan elektronik sebagai alat bukti dalam hukum acara perdata. | |||||||||
