Abstract

The era of globalization has led to economic openness across countries, which also means there is freedom of movement. As a result, there has been a significant increase in worker mobility between countries, with migrant workers relocating to other nations for residence and employment. Indonesian Migrant Workers (PMI) often face abuse or inhumane treatment in their host countries. Therefore, when PMI encounter issues abroad, state responsibility arises. The Indonesian government has signed the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families, demonstrating its commitment to protecting, respecting, promoting, and fulfilling the rights of all migrant workers and their families. The problem identified in this research is how the Indonesian government ensures the protection of migrant workers and the steps taken based on the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families regarding the abuse of Indonesian migrant workers in Myanmar. Theories used in this study include the Theory of Legal Protection for Workers and the Theory of State Obligation. The research method used is a normative juridical approach, with a legislative approach, an approach to news related to online gambling, and a case approach. The data used is secondary data, consisting of primary, secondary, and tertiary legal sources, with data collection techniques through library research. The research results suggest that the government needs a comprehensive and coordinated approach to address the issue of migrant worker abuse. The proposed strategy includes strengthening laws and policies, improving monitoring and law enforcement, raising awareness and education, and enhancing international cooperation. Pre-departure education is crucial to ensure that migrant workers understand their rights and can identify risks of fraud or illegal practices. The Indonesian government faces difficulties and must cooperate with international authorities and organizations such as GASO and Interpol.

Additional Information: Era globalisasi telah menciptakan keterbukaan ekonomi semua negara yang juga berarti terdapat kebebasan, Dampaknya banyak sekali mobilitas pekerja antar negara-negara, para pekerja bermigrasi ke negara lain untuk menetap dan bekerja di negara lain. Pekerja Migran Indonesia (PMI) seringkali mengalami penyiksaan atau perlakuan yang tidak manusiawi di negara penempatan. Sehingga ketika PMI menghadapi masalah di luar negeri maka timbul pertanggungjawaban negara, Sehingga pemerintah Indonesia telah menandatangani International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families. Penandatanganan menunjukkan kesungguhan Negara Indonesia untuk melindungi, menghormati, memajukan dan memenuhi hak-hak seluruh pekerja migran dan anggota keluarganya. Identifikasi masalah yang diambil dalam penelitian ini adalah bagaimana tindakan perlindungan terhadap pekerja migran Indonesia dan bagaimana langkah-langkah pemerintah berdasarkan International Convention on the Protection of the Rights of All Migrant Workers and The Members of Their Families terhadap tindakan penyekapan pekerja migran Indonesia di Myanmar. Teori yang digunakan adalah teori Perlindungan Hukum Tenaga Kerja dan Teori Kewajiban Negara. Metode penelitian ini menggunakan metode penelitian yuridis normatif, dengan spesifikasi penelitian yang digunakan adalah pendekatan perundang-undangan, pendekatan berita mengenai perjudian online dan pendekatan kasus. Sumber data yang digunakan adalah data sekunder yang didalamnya terdiri dari bahan hukum primer, sekunder dan tersier, dengan teknik pengumpulan data studi Pustaka. Hasil penelitian yang diapatkan yaitu pemerintah menggunakan langkah yang komprehensif dan terkoordinasi diperlukan untuk menangani masalah penyekapan pekerja migran. Strategi yang diusulkan meliputi penguatan hukum dan kebijakan, peningkatan pengawasan dan penegakan hukum, peningkatan kesadaran dan edukasi, serta kerjasama internasional. Edukasi sebelum keberangkatan menjadi landasan penting untuk memastikan PMI memahami hak-hak mereka dan dapat mengidentifikasi risiko penipuan atau praktik ilegal. Pemerintah Indonesia mengalami kesulitan dan perlu melakukan kerjasama dengan otoritas internasional dan organisasi seperti GASO dan Interpol.
