Abstract

Land certificates are official documents that serve as proof of ownership rights as referred to in Article 19 paragraph (2) letter c of the Basic Agrarian Law (UUPA), which apply to land rights, management rights, waqf land, ownership rights of apartment units, and security rights, all of which have been registered in the respective land books. In the era of digitalization, the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) has introduced a reform concerning land ownership documents, namely the Electronic Land Certificate. This research aims to analyze the implementation of the Electronic Land Certificate and the challenges faced in its enforcement in Lebak Regency. The regulation regarding Electronic Land Certificates is governed by Ministerial Regulation Number 3 of 2023 concerning the Issuance of Electronic Documents in Land Registration Activities. The problem identified in this study is how the implementation of the Electronic Land Certificate serves as a guarantee of legal certainty at the National Land Agency Office in Lebak Regency, and what challenges are faced in its implementation in the region. The method used in this research is empirical juridical, namely a sociological legal research method or field research that examines the applicable legal norms and their application in society. The type of research applied is qualitative research, with data obtained through literature studies and fieldwork. The data in this study were collected through interviews with officials at the Lebak Land Office, Land Deed Officials (PPAT), and several residents of Lebak who own Electronic Land Certificates. Based on research findings and literature, since its implementation in June 2024, the application of the Electronic Land Certificate in Lebak Regency has not been fully effective. This is due to several obstacles, including limited human resources, inadequate infrastructure, frequent server downtimes, and the public’s limited understanding of the Electronic Land Certificate. Therefore, the Land Office of Lebak Regency needs to conduct evaluations and address these challenges.

Additional Information: Sertipikat tanah merupakan surat tanda bukti hak sebagaimana yang dimaksud dalam Pasal 19 ayat (2) huruf c UUPA untuk hak atas tanah, hak pengelolaan, tanah wakaf, hak milik atas satuan rumah susun dan hak tanggungan yang masing-masing sudah dibukukan dalam buku tanah yang bersangkutan. Di era digitalisasi Kementerian ATR/BPN melakukan pembaharuan terkait dokumen kepemilikan tanah yakni Sertipikat Tanah Elektronik. Penelitian ini bertujuan untuk menganalisis implementasi pemberlakuan Sertipikat Tanah Elektronik dan kendala yang dihadapi dalam pemberlakuan Sertipikat Tanah Elektronik di Kabupaten Lebak. Regulasi terkait Sertipikat Elektronik diatur dalam Peraturan Menteri Nomor 3 Tahun 2023 tentang Penerbitan Dokumen Elektronik dalam kegiatan Pendaftaran Tanah. Identifikasi masalah pada penelitian ini adalah Bagaimana pemberlakuan Sertipikat Tanah Elektronik Sebagai Jaminan Kepastian Hukum di Badan Pertanahan Nasional Kabupaten Lebak dan bagaimana kendala dalam pemberlakuan Sertipikat Tanah Elektronik di Kabupaten Lebak. Metode yang digunakan dalam penelitian ini adalah yuridis normatif, dengan cara mengkaji dan menganalisis peraturan perundang-undangan. Jenis penelitian yang digunakan adalah penelitian kualitatif dengan pengolahan data studi kepustakaan dan lapangan. Data yang diperoleh pada penelitian ini melalui wawancara dengan pejabat Kantor Pertanahan Lebak, PPAT dan beberapa masyarakat Lebak yang memiliki Sertipikat Tanah Elektronik Sebagaimana hasil penilitian dan beberapa literatur bahwa sejak diberlakukannya pada Juni 2024 penerapan Sertipikat Tanah Elektronik di Kabupaten Lebak masih belum maksimal, hal ini disebabkan oleh beberapa kendala diantaranya adalah sumber daya manusia, infrastruktur yang belum memadai, server yang sering down serta pemahaman masyarakat yang masih tabu dengan Sertipikat Tanah Elektronik. Oleh sebab itu Kantor Pertanahan Kabupaten Lebak perlu melakukan evaluasi dan penyelesaian terhadap kendala tersebut.
