Abstract
Ulayat Rights are constitutional rights held by Tribal Peoples as a social entity. Ulayat rights include customary land and customary forests. For decades, indigenous people have protected and used the products of customary forests to support their livelihoods. Even if Tribal Peoples' existence and rights are recognized normatively, the government's policies continue to overlook their existence. The aim of this research is to determine how Tribal Peoples' customary forest rights are protected. Furthermore, the aim of this research is to formulate sustainable development measures that will support customary forest protection. This study employs normative legal methods with secondary data gathered through a literature review. The research findings reveal that, notwithstanding a Constitutional Court decision on customary forests, the DPR does not perceive this to be a new legal politics. Aside from that, when implementing policies, the government continues to provide corporations the ability to conduct business activities in customary forests. This resulted in a violation of Tribal Peoples' constitutional rights, which has since been an ongoing issue. The government's commitment to implementing environmental protection through sustainable development processes should serve as the first step toward recognizing, respecting, and fulfilling Tribal Peoples' constitutional rights. This is significant, especially since the concept of Indonesian State of Law emphasizes legal protection for all Indonesian citizens.

| Additional Information: | Hak Ulayat merupakan hak konstitusional yang dimiliki oleh Masyarakat Hukum Adat sebagai suatu entitas sosial. Hak Ulayat terdiri atas tanah adat dan hutan adat. Masyarakat Hukum Adat secara turun temurun telah menjaga serta memanfaatkan hasil yang didapatkan dari hutan adat untuk penghidupan. Meskipun secara normatif pengakuan terhadap keberadaan Masyarakat Hukum Adat beserta hak yang dimilikinya telah diakui namun pengimplementasian kebijakan yang dilakukan pemerintah masih cenderung mengabaikan eksistensinya. Penelitian ini bertujuan untuk mengetahui perlindungan hak Masyarakat Hukum Adat atas Hutan Adat. Selain itu, penelitian ini juga bertujuan untuk mengkonstruksikan pelestarian hutan adat melalui mekanisme pembangunan berkelanjutan. Penelitian ini menggunakan metode yuridis normatif dengan data sekunder yang didapatkan melalui studi kepustakan. Hasil penelitian menunjukan, meskipun telah ada Putusan Mahkamah Konstitusi yang berkaitan dengan hutan adat namun DPR masih belum menganggap hal tersebut sebagai politik hukum baru. Selain itu, pemerintah juga dalam implementasi kebijakan masih memberikan hak kepada korporasi untuk melakukan kegiatan usaha pada hutan adat. Hal ini yang kemudian mengakibatkan terlanggarnya hak konstitusional Masyarakat Hukum Adat menjadi permasalahan yang belum dapat diselesaikan. Komitmen pemerintah dalam melaksanakan perlindungan lingkungan melalui mekanisme pembangunan berkelanjutan seharusnya dapat menjadi langkah awal untuk mengakui, menghormati, dan memenuhi hak konstitusional Masyarakat Hukum Adat. Hal ini menjadi penting terutama konsep Negara Hukum Indonesia menekankan pada perlindungan hukum bagi seluruh warga negara Indonesia. | |||||||||
