Abstract
Business legality as a form of official recognition from the Government of the existence of a business or its product business through the granting of legal permits. Business legality for MSME actors is an important factor in the development of people's businesses, including in Cimarga District, Lebak Regency. This is in accordance with the provisions of Article 37 paragraph (1) and (2) of PP Number 7 of 2021 concerning Ease, Protection, and Empowerment of Cooperatives and Micro, Small, and Medium Enterprises. Business legality will provide legal protection, wider market access, and ease in business development. However, many MSME actors do not yet have business legality. The identification of this research problem is how is the implementation of business legality for MSME actors in Cimarga District, Lebak Regency as a form of developing people's businesses and what are the obstacles or barriers in the implementation of business legality for MSME actors in Cimarga District, Lebak Regency, and how to overcome them. The theory in this study is the theory of legal protection and the theory of legal awareness. Empirical legal research is the method used in this study. The results of this study indicate that the implementation of business legality for MSME actors in Cimarga District, Lebak Regency as a form of developing people's businesses has not been running optimally. This can be seen from the fact that many MSME actors do not yet have business legality, either administrative or operational such as Business Identification Number (NIB), Taxpayer Identification Number (NPWP), Trade Business License (SIUP), Brand, or distribution permit such as Household Industry License (PIRT), Halal Certificate, Food and Drug Supervisory Agency (BPOM). The main obstacles are the lack of synergy between the Cooperatives and MSMEs Service and the village government, the low understanding of business actors regarding the importance of legality, limitations in the use of the online based Online Single Submission (OSS) system. To overcome these obstacles, it is necessary to increase socialization and education to MSME actors regarding the importance of business legality, expand coaching not only in the culinary sector but also in the non-culinary sector, and increase coordination and synergy between the Cooperatives and MSMEs Service of Lebak Regency and the village government to the RT/RW level for the process of managing business legality more effectively. Simplification of OSS terms is also recommended to make it easier for the general public to understand.

| Additional Information: | Legalitas usaha sebagai bentuk pengakuan resmi dari Pemerintah terhadap keberadaan bisnis atau usaha produknya melalui pemberian izin secara hukum. Legalitas usaha bagi pelaku UMKM menjadi faktor penting dalam pengembangan usaha rakyat, termasuk di Kecamatan Cimarga, Kabupaten Lebak. Hal tersebut sesuai dengan ketentuan Pasal 37 ayat (1) dan (2) PP Nomor 7 Tahun 2021 Tentang Kemudahan, Perlindungan, dan Pemberdayaan Koperasi dan Usaha Mikro, Kecil, dan Menengah. Legalitas usaha akan memberikan perlindungan hukum, akses pasar yang lebih luas, dan kemudahan dalam pengembangan usaha. Namun, banyak pelaku UMKM belum memiliki legalitas usaha. Identikasi masalah penelitian ini yaitu bagaimanakah pelaksanaan legalitas usaha bagi pelaku UMKM di Kecamatan Cimarga, Kabupaten Lebak sebagai wujud pengembangan usaha rakyat dan apakah kendala atau hambatan dalam pelaksanaan legalitas usaha bagi pelaku UMKM di Kecamatan Cimarga, Kabupaten Lebak, dan bagaimana cara mengatasinya. Teori dalam penelitian ini adalah teori perlindungan hukum dan teori kesadaran hukum. Penelitian yuridis empiris merupakan metode yang digunakan dalam penelitian ini. Hasil dari penelitian ini menunjukkan bahwa implementasi legalitas usaha bagi pelaku UMKM di Kecamatan Cimarga Kabupaten Lebak sebagai wujud pengembangan usaha rakyat, belum berjalan secara optimal. Hal ini terlihat dari masih banyaknya pelaku UMKM yang belum memiliki legalitas usaha, baik yang bersifat administrasi atau operasional seperti Nomor Induk Berusaha (NIB), Nomor Pokok Wajib Pajak (NPWP), Surat Izin Usaha Perdagangan (SIUP), Merek, maupun izin edar seperti Perizinan Industri Rumah Tangga (PIRT), Sertifikat Halal, Badan Pengawas Obat dan Makanan (BPOM). Kendala utama yaitu kurangnya sinergi antara Dinas Koperasi dan UKM dengan pemerintahan desa, rendahnya pemahaman pelaku usaha terhadap pentingnya legalitas, keterbatasan dalam penggunaan sistem Online Single Submission (OSS) berbasis daring. Untuk mengatasi kendala tersebut, diperlukan peningkatan sosialisasi dan edukasi kepada para pelaku UMKM mengenai pentingnya legalitas usaha, perluasan pembinaan tidak hanya pada sektor kuliner tetapi juga sektor non-kuliner, serta peningkatan koordinasi dan sinergi antara Dinas Koperasi dan UKM Kabupaten Lebak dengan pemerintah desa hingga tingkat RT/RW guna proses pengurusan legalitas usaha secara lebih efektif. Penyederhanaan istilah OSS juga disarankan agar lebih mudah dipahami oleh masyarakat luas. | |||||||||
